 1                       HOUSE JOINT RESOLUTION

 2        WHEREAS, Health care service contracts between  insurers,
 3    health  plans,  businesses, unions, health care professionals
 4    and health care providers have become the primary  method  of
 5    arranging  for  the  delivery of health care to the people of
 6    Illinois; and

 7        WHEREAS,  The  Illinois  General  Assembly  is  currently
 8    debating the Fairness in Health Care Services Contracting Act
 9    which attempts to ensure that both parties to a contract  for
10    the  provision  of  health care services understand the terms
11    and conditions for the provision of those services; and

12        WHEREAS, The professional services contracts entered into
13    between health care plans and health care  professionals  and
14    health  care  providers  have  a  significant  impact  on the
15    delivery of health care services to the people  of  Illinois;
16    and

17        WHEREAS,  The  relationship  between the health care plan
18    contract with the professionals and providers is akin to  the
19    insurance policy for coverage with the insureds or enrollees;
20    therefore, be it

21        RESOLVED,   BY   THE  HOUSE  OF  REPRESENTATIVES  OF  THE
22    NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS,  THE
23    SENATE  CONCURRING HEREIN, that there is created the Illinois
24    Legislative Task Force on Fairness in  Health  Care  Services
25    Contracting  consisting  of seven voting members; one of whom
26    shall be a member of the Senate appointed by the President of
27    the Senate who shall serve as  Co-chairperson,  one  of  whom
28    shall  be  a  member  of the Senate appointed by the Minority
29    Leader of the Senate, one of whom shall be a  member  of  the
30    House  of  Representatives  appointed  by  the Speaker of the
31    House of Representatives who shall serve  as  Co-chairperson,
32    one of whom shall be a member of the House of Representatives

 1    appointed   by   the   Minority   Leader   of  the  House  of
 2    Representatives, and the Director of Insurance or his or  her
 3    designee,  the  Director  of  Public  Health  or  his  or her
 4    designee, and the Attorney General or his  or  her  designee;
 5    and be it further

 6        RESOLVED,  That  the  Task  Force  shall  include sixteen
 7    non-voting  members;  including  one  representative  of  the
 8    following organizations; Illinois Hospital and  HealthSystems
 9    Association,  Illinois  State Dental Society, Illinois Nurses
10    Association, Illinois Pharmacists Association, Illinois State
11    Medical Society, Illinois Podiatric Medical Society, Illinois
12    Optometric  Association,  Illinois  Association  of  Clinical
13    Psychologists, Illinois Association of  Freestanding  Surgery
14    Centers, Illinois Association of Health Plans, Managed Health
15    Providers  Association, Illinois Life Insurance Council, Blue
16    Cross/Blue  Shield  of   Illinois,   Illinois   Manufacturers
17    Association,  Illinois Retail Merchants Association, AFL/CIO,
18    and the City of Chicago; and be it further

19        RESOLVED, That the meetings of the Task  Force  shall  be
20    held  at  the  call  of  the  Co-chairpersons  and  that  the
21    non-voting  members  of  the  Task  Force shall serve without
22    compensation; and be it further

23        RESOLVED, That the Task Force shall study the health plan
24    professional and provider services contracting  process;  and
25    be it further

26        RESOLVED,  That the Task Force shall conduct at least two
27    hearings in the Chicago metropolitan  area  and  one  hearing
28    outside the Chicago metropolitan area; and be it further

29        RESOLVED,   That   the   Task   Force  shall  report  its
30    recommendations to the General Assembly and  Governor  on  or
31    before December 31, 2001.
