 1        AN ACT concerning higher education.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The University of Illinois Act is amended  by
 5    adding Section 7e-5 as follows:

 6        (110 ILCS 305/7e-5 new)
 7        Sec. 7e-5.  In-state tuition charge.
 8        (a)  For  tuition  purposes,  the  Board of Trustees must
 9    classify an individual who is  not  a  citizen  or  permanent
10    resident  of the United States as an Illinois resident, until
11    the individual establishes a residence outside of this State,
12    if all of the following conditions are met:
13             (1)  The individual resided with his or  her  parent
14        or  guardian  while  attending  a  public or private high
15        school in this State.
16             (2)  The  individual  graduated  from  a  public  or
17        private high school or received the equivalent of a  high
18        school diploma in this State.
19             (3)  The  individual  resided  in  this State for at
20        least 3 years as of the  date  the  individual  graduated
21        from  high  school  or  received the equivalent of a high
22        school diploma.
23             (4)  The individual registers as an entering student
24        in  the  University  not  earlier  than  the  2002   fall
25        semester.
26             (5)  The  individual  provides  to the University an
27        affidavit  stating  that  the  individual  will  file  an
28        application to become a permanent resident of the  United
29        States  at  the  earliest  opportunity  the individual is
30        eligible to do so.
31        (b)  An alien who is living in the United States and  who

 1    (i)  has been lawfully admitted for permanent residence or as
 2    a refugee, (ii) has been granted asylum, or (iii) has applied
 3    to the Immigration  and  Naturalization  Service  for  lawful
 4    permanent  resident  status  or has had a sponsoring petition
 5    filed on his or her behalf for purposes of  obtaining  lawful
 6    permanent  resident  status, must be given the same privilege
 7    of  qualifying  for  resident  status  for  tuition  and  fee
 8    purposes as a citizen of the United States.
 9        (c)  An individual who is 18 years of age or under or  is
10    a  dependent  and  who,  along  with  one of the individual's
11    parents, was formerly a resident of this State is entitled to
12    pay tuition at the rate provided for  Illinois  residents  if
13    all of the following conditions are met:
14             (1)  The  individual  and  the  parent with whom the
15        individual primarily resides change their legal residence
16        from this State to another state.
17             (2)  The other parent, with whom the individual does
18        not primarily reside, continues to reside in  this  State
19        and  is  not  delinquent  on  the  payment  of  any child
20        support.
21        (d)  This Section applies only to tuition for a  term  or
22    semester  that  begins on or after the effective date of this
23    amendatory Act of the 92nd General Assembly.

24        Section 10.  The Southern Illinois University  Management
25    Act is amended by adding Section 8d-5 as follows:

26        (110 ILCS 520/8d-5 new)
27        Sec. 8d-5.  In-state tuition charge.
28        (a)  For  tuition  purposes,  the  Board must classify an
29    individual who is not a citizen or permanent resident of  the
30    United  States  as an Illinois resident, until the individual
31    establishes a residence outside of this State, if all of  the
32    following conditions are met:

 1             (1)  The  individual  resided with his or her parent
 2        or guardian while attending  a  public  or  private  high
 3        school in this State.
 4             (2)  The  individual  graduated  from  a  public  or
 5        private  high school or received the equivalent of a high
 6        school diploma in this State.
 7             (3)  The individual resided in  this  State  for  at
 8        least  3  years  as  of the date the individual graduated
 9        from high school or received the  equivalent  of  a  high
10        school diploma.
11             (4)  The individual registers as an entering student
12        in   the  University  not  earlier  than  the  2002  fall
13        semester.
14             (5)  The individual provides to  the  University  an
15        affidavit  stating  that  the  individual  will  file  an
16        application  to become a permanent resident of the United
17        States at the  earliest  opportunity  the  individual  is
18        eligible to do so.
19        (b)  An  alien who is living in the United States and who
20    (i) has been lawfully admitted for permanent residence or  as
21    a refugee, (ii) has been granted asylum, or (iii) has applied
22    to  the  Immigration  and  Naturalization  Service for lawful

 7    semester that begins on or after the effective date  of  this
 8    amendatory Act of the 92nd General Assembly.

 9        Section  15.  The Chicago State University Law is amended
10    by adding Section 5-88 as follows:

11        (110 ILCS 660/5-88 new)
12        Sec. 5-88.  In-state tuition charge.
13        (a)  For tuition purposes, the  Board  must  classify  an
14    individual  who is not a citizen or permanent resident of the
15    United States as an Illinois resident, until  the  individual
16    establishes  a residence outside of this State, if all of the
17    following conditions are met:
18             (1)  The individual resided with his or  her  parent
19        or  guardian  while  attending  a  public or private high
20        school in this State.
21             (2)  The  individual  graduated  from  a  public  or
22        private high school or received the equivalent of a  high
23        school diploma in this State.
24             (3)  The  individual  resided  in  this State for at
25        least 3 years as of the  date  the  individual  graduated
26        from  high  school  or  received the equivalent of a high
27        school diploma.

28        Section  20.  The  Eastern  Illinois  University  Law  is
29    amended by adding Section 10-88 as follows:

30        (110 ILCS 665/10-88 new)
31        Sec. 10-88.  In-state tuition charge.
32        (a)  For tuition purposes, the  Board  must  classify  an

 1    individual  who is not a citizen or permanent resident of the
 2    United States as an Illinois resident, until  the  individual

10        (d)  This Section applies only to tuition for a  term  or
11    semester  that  begins on or after the effective date of this
12    amendatory Act of the 92nd General Assembly.

13        Section  25.  The  Governors  State  University  Law   is
14    amended by adding Section 15-88 as follows:

15        (110 ILCS 670/15-88 new)
16        Sec. 15-88.  In-state tuition charge.
17        (a)  For  tuition  purposes,  the  Board must classify an
18    individual who is not a citizen or permanent resident of  the
19    United  States  as an Illinois resident, until the individual
20    establishes a residence outside of this State, if all of  the
21    following conditions are met:
22             (1)  The  individual  resided with his or her parent
23        or guardian while attending  a  public  or  private  high
24        school in this State.
25             (2)  The  individual  graduated  from  a  public  or
26        private  high school or received the equivalent of a high
27        school diploma in this State.
28             (3)  The individual resided in  this  State  for  at
29        least  3  years  as  of the date the individual graduated
30        from high school or received the  equivalent  of  a  high
31        school diploma.
32             (4)  The individual registers as an entering student

31    amendatory Act of the 92nd General Assembly.

32        Section 30.  The Illinois State University Law is amended
33    by adding Section 20-88 as follows:

 2        Sec. 20-88.  In-state tuition charge.
 3        (a)  For  tuition  purposes,  the  Board must classify an
 4    individual who is not a citizen or permanent resident of  the
 5    United  States  as an Illinois resident, until the individual
 6    establishes a residence outside of this State, if all of  the
 7    following conditions are met:
 8             (1)  The  individual  resided with his or her parent
 9        or guardian while attending  a  public  or  private  high
10        school in this State.
11             (2)  The  individual  graduated  from  a  public  or
12        private  high school or received the equivalent of a high
13        school diploma in this State.
14             (3)  The individual resided in  this  State  for  at
15        least  3  years  as  of the date the individual graduated
16        from high school or received the  equivalent  of  a  high
17        school diploma.
18             (4)  The individual registers as an entering student
19        in   the  University  not  earlier  than  the  2002  fall
20        semester.
21             (5)  The individual provides to  the  University  an

16        Section  35.  The Northeastern Illinois University Law is
17    amended by adding Section 25-88 as follows:

18        (110 ILCS 680/25-88 new)
19        Sec. 25-88.  In-state tuition charge.
20        (a)  For tuition purposes, the  Board  must  classify  an
21    individual  who is not a citizen or permanent resident of the
22    United States as an Illinois resident, until  the  individual
23    establishes  a residence outside of this State, if all of the
24    following conditions are met:
25             (1)  The individual resided with his or  her  parent
26        or  guardian  while  attending  a  public or private high
27        school in this State.
28             (2)  The  individual  graduated  from  a  public  or
29        private high school or received the equivalent of a  high
30        school diploma in this State.
31             (3)  The  individual  resided  in  this State for at
32        least 3 years as of the  date  the  individual  graduated

30        and  is  not  delinquent  on  the  payment  of  any child
31        support.
32        (d)  This Section applies only to tuition for a  term  or
33    semester  that  begins on or after the effective date of this
34    amendatory Act of the 92nd General Assembly.

 1        Section 40.  The  Northern  Illinois  University  Law  is
 2    amended by adding Section 30-88 as follows:

 3        (110 ILCS 685/30-88 new)
 4        Sec. 30-88.  In-state tuition charge.
 5        (a)  For  tuition  purposes,  the  Board must classify an
 6    individual who is not a citizen or permanent resident of  the
 7    United  States  as an Illinois resident, until the individual
 8    establishes a residence outside of this State, if all of  the
 9    following conditions are met:
10             (1)  The  individual  resided with his or her parent
11        or guardian while attending  a  public  or  private  high
12        school in this State.
13             (2)  The  individual  graduated  from  a  public  or
14        private  high school or received the equivalent of a high
15        school diploma in this State.
16             (3)  The individual resided in  this  State  for  at
17        least  3  years  as  of the date the individual graduated
18        from high school or received the  equivalent  of  a  high
19        school diploma.
20             (4)  The individual registers as an entering student
21        in   the  University  not  earlier  than  the  2002  fall
22        semester.

17    semester that begins on or after the effective date  of  this
18    amendatory Act of the 92nd General Assembly.

19        Section  45.  The  Western  Illinois  University  Law  is
20    amended by adding Section 35-88 as follows:

21        (110 ILCS 690/35-88 new)
22        Sec. 35-88.  In-state tuition charge.
23        (a)  For  tuition  purposes,  the  Board must classify an
24    individual who is not a citizen or permanent resident of  the
25    United  States  as an Illinois resident, until the individual
26    establishes a residence outside of this State, if all of  the
27    following conditions are met:
28             (1)  The  individual  resided with his or her parent
29        or guardian while attending  a  public  or  private  high
30        school in this State.
31             (2)  The  individual  graduated  from  a  public  or
32        private  high school or received the equivalent of a high

 1        school diploma in this State.
 2             (3)  The individual resided in  this  State  for  at
 3        least  3  years  as  of the date the individual graduated
 4        from high school or received the  equivalent  of  a  high

 4        Section  99.  Effective date.  This Act takes effect upon
