92_HB5868eng HB5868 Engrossed LRB9214552AGmbC 1 AN ACT concerning disease prevention. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Communicable Disease Prevention Act is 5 amended by changing Section 2 as follows: 6 (410 ILCS 315/2) (from Ch. 111 1/2, par. 22.12) 7 Sec. 2. Immunization of children. 8 (a) The Department of Public Health must promulgate 9 rules and regulations (i) requiring immunization of children 10 against diptheria, tetanus, measles, mumps, rubella, 11 poliomyelitis, hepatitis B, and chickenpox and (ii) requiring 12 individuals administering or confirming the administration of 13 the required immunizations to report to the Department of 14 Public Health that the immunizations were administered. 15 (b) The Department of Public Health shall also 16 promulgate rules and regulations requiring immunization of 17 children against other preventable communicable diseases 18 designated by the Director. Before any regulation or 19 amendment thereto is prescribed under this subsection, the 20 Department shall conduct a public hearing regarding such 21 regulation. In addition, before any regulation or any 22 amendment to a regulation is adopted under this subsection, 23 and after the Immunization Advisory Committee has made its 24 recommendations, the State Board of Health shall conduct 3 25 public hearings, geographically distributed throughout the 26 State, regarding the regulation or amendment to the 27 regulation. At the conclusion of the hearings, the State 28 Board of Health shall issue a report, including its 29 recommendations, to the Director. The Director shall take 30 into consideration any comments or recommendations made by 31 the Board based on these hearings. The Department may HB5868 Engrossed -2- LRB9214552AGmbC 1 prescribe additional rules and regulations under this 2 subsection for immunization of other diseases as vaccines are 3 developed. 4 (c) The provisions of this Act shall not apply if: 5 (1)1.The parent or guardian of the child objects 6 thereto on the grounds that the administration of 7 immunizing agents conflicts with his religious tenets or 8 practices or, 9 (2)2.A physician employed by the parent or 10 guardian to provide care and treatment to the child 11 states that the physical condition of the child is such 12 that the administration of one or more of the required 13 immunizing agents would be detrimental to the health of 14 the child. 15 (d) The Department of Public Health shall compile an 16 annual statistical report on the immunization status of 17 Illinois children, including percentages and numbers 18 immunized against each disease or group of diseases for which 19 immunization is available. The report shall be submitted to 20 the General Assembly annually and shall not exceed 3 pages in 21 length. 22 (Source: P.A. 90-607, eff. 6-30-98.)
