 1        AN ACT concerning local government.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Illinois Municipal  Code  is  amended  by
 5    changing Section 8-12-5 as follows:

 6        (65 ILCS 5/8-12-5) (from Ch. 24, par. 8-12-5)
 7        Sec.  8-12-5.  For  each  financially  distressed city to
 8    which this Division applies  is  applicable  as  provided  in
 9    Section  8-12-4,  there  is established a body both corporate
10    and  politic  to  be  known  as  the  "(Name  of  Financially
11    Distressed City) Financial Advisory Authority" which, in such
12    name, shall exercise all authority vested in  such  Authority
13    by  this  Division.  The Authority shall constitute an agency
14    of State government, and  as  such  may  receive  and  expend
15    amounts appropriated by the General Assembly to the Authority
16    to   enable  it  to  exercise  and  perform  its  powers  and
17    responsibilities  under  this  Division.    The   financially
18    distressed city shall not be liable for any costs or expenses
19    incurred  by  the  Authority in the conduct of its powers and
20    responsibilities under this Division.

22        Section 10.  The  School  Code  is  amended  by  changing
23    Section 1B-9 as follows:

24        (105 ILCS 5/1B-9) (from Ch. 122, par. 1B-9)
25        Sec.  1B-9.  Assistance by State agencies, units of local
26    government or school districts.  The local board shall render
27    such services to, and permit the use of  its  facilities  and
28    resources  by,  the Financial Oversight Panel at no charge as
29    may be requested by the Panel.  Any  State  agency,  unit  of

 1    local   government,   or  school  district  may,  within  its
 2    respective lawful powers and duties, render such services  to
 3    the  Panel  as may be requested by the Panel. Upon request of
 4    the Panel, any such  agency,  unit  of  local  government  or
 5    school district is hereby authorized and empowered to loan to
 6    the  Panel such officers and employees as the Panel deems may
 7    deem necessary and request in carrying  out  its  powers  and
 8    duties.  Officers and employees so transferred shall not lose
 9    or forfeit their employment status or rights.
