 1        AN ACT concerning vehicles.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Illinois  Vehicle  Code  is amended by
 5    changing Sections 1-101.8 and 1-217 as follows:

 6        (625 ILCS 5/1-101.8) (from Ch. 95 1/2, par. 1-102.02)
 7        Sec.  1-101.8.   All-terrain  vehicle.    Any   motorized
 8    off-highway  device designed to travel primarily off-highway,
 9    50 inches or less  in  width,  having  a  manufacturer's  dry
10    weight  of  900  600  pounds  or less, traveling on 3 or more
11    low-pressure tires,  designed  with  a  seat  or  saddle  for
12    operator  use,  and handlebars or steering wheel for steering
13    control, except equipment such as lawnmowers.

16        Sec. 1-217. Vehicle. Every device, in, upon or  by  which
17    any person or property is or may be transported or drawn upon
18    a  highway  or requiring a certificate of title under Section
19    3-101(d) of this Code, except devices moved by  human  power,
20    devices  used exclusively upon stationary rails or tracks and
21    snowmobiles as defined in  the  Snowmobile  Registration  and
22    Safety Act.
23        For   the   purposes   of  this  Code,  unless  otherwise
24    prescribed, a device shall be  considered  to  be  a  vehicle
25    until  such  time  it either comes within the definition of a
26    junk vehicle, as  defined  under  this  Code,  or  a  junking
27    certificate is issued for it.
28        For this Code, vehicles are divided into 2 divisions:
29        First  Division:  Those motor vehicles which are designed
30    for the carrying of not more than 10 persons.

 1        Second Division: Those vehicles which  are  designed  for
 2    carrying  more  than  10  persons, those designed or used for
 3    living quarters and those vehicles  which  are  designed  for
 4    pulling  or  carrying property, freight or cargo, those motor
 5    vehicles of the First Division remodelled for use and used as
 6    motor vehicles  of  the  Second  Division,  and  those  motor
 7    vehicles  of the First Division used and registered as school
 8    buses.

10        Section 99.  Effective date.  This Act takes effect  upon
11    becoming law.
