 1                    AMENDMENT TO HOUSE BILL 4174

 2        AMENDMENT NO.     .  Amend House Bill 4174 as follows:

 3    by replacing everything after the enacting  clause  with  the
 4    following:

 5        "Section  5.   The  Illinois  Vehicle  Code is amended by
 6    adding Section 6-117.1 as follows:

 7        (625 ILCS 5/6-117.1 new)
 8        Sec. 6-117.1. Fingerprint identification.
 9        (a)  A    fingerprint-based    driver's    license    and
10    identification card is  needed  in  light  of  terrorism  and
11    identity  theft.  Linking  digital  photographs  with  a name
12    confirmed by  fingerprints  prevents  and  reduces  fraud  in
13    commercial   transactions,   transportation   security,   and
14    benefits provided by government entitlement programs.
15        The  150  Secretary  of State facilities could be used to
16    create a data entry point with easy access to consumers,  and
17    this  could  interface  with  the  State Police's databank of
18    3,000,000 records in the Automated Fingerprint Identification
19    System.  Our State infrastructure  can  also  link  with  the
20    federal government.
21        The   General  Assembly  finds  that  reliable  biometric

 1    identification for all driver's licenses  and  identification
 2    cards issued by the Secretary of State is a positive step for
 3    the  safety  and  security of Illinois residents and personal
 4    and public property. Fingerprint technology has  been  proven
 5    to provide accurate, reliable, and timely identification in a
 6    wide  variety  of  applications,  and  the  need will be even
 7    greater as our country deals with terrorism.
 8        (b)  The Secretary of State and the Department  of  State
 9    Police  shall  jointly  develop  policies  and  procedures to
10    capture  and  encode  fingerprint  information  on   driver's
11    licenses and identification cards issued by the Secretary.
12        (c)  The  Secretary  and  the  Department of State Police
13    shall submit  a  report  to  the  Governor  and  the  General
14    Assembly  not  later  than  April  1,  2003  on  the proposed
15    policies,  procedures,  costs  of  implementation,  and   any
16    recommended changes to administrative rules and laws.
17        (d)  The  Secretary shall implement procedures to capture
18    and encode fingerprint information on all Illinois  residents
19    who  wish to have that information on their driver's licenses
20    and identification  cards  issued  on  or  after  January  1,
21    2005.".
