1 AN ACT concerning environmental protection.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended
5 by changing Section 12.1 as follows:
6 (415 ILCS 5/12.1) (from Ch. 111 1/2, par. 1012.1)
7 Sec. 12.1. Underground injection of hazardous waste;
8 prohibition.
9 (a) Commencing June 30, 1984 and until January 1, 1986,
10 no person shall cause, threaten or allow the underground
11 injection of hazardous waste unless:
12 (1) the underground injection is into an existing
13 well or a replacement well; and
14 (2) the underground injection will not violate this
15 Act or any regulation or standard adopted by the Board
16 under this Act.
17 (b) For purposes of this Section, an existing well is a
18 well that is in existence on the effective date of this
19 amendatory Act of 1984.
20 (c) For purposes of this Section, a replacement well is
21 a well that:
22 (1) replaces an existing inoperative or stand-by
23 well; and
24 (2) is located within the same site as the
25 inoperative existing well.
