 1        AN ACT in relation to criminal law.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The Boarding Aircraft  With  Weapon  Act  is
 5    amended  by  changing Sections 1 and 7 and adding Section 1.5
 6    as follows:

 7        (720 ILCS 545/1) (from Ch. 38, par. 84-1)
 8        Sec. 1.  Boarding or attempting to  board  aircraft  with
 9    weapon.  It is unlawful for any person to board or attempt to
10    board any commercial or charter aircraft, having  in  his  or
11    her possession any of the following:
12        (1)  a firearm;
13        (2)  an  explosive  or  bomb  of  any  type (other than a
14    firecracker), a container holding poison or noxious gas, or a
15    biological,  chemical,  or  radioactive  substance  if   that
16    substance  is  likely  to cause death or great bodily harm to
17    any person;
18        (3)  a knife of any length, composition, or  description,
19    a cutting instrument of any kind and composition, including a
20    carpet  knife  or  cutter or a spare blade, any device with a
21    folding or retractable blade, an  ice  pick,  or  a  straight
22    razor; or
23        (4)  any  other  lethal  or  dangerous  weapon.  firearm,
24    explosive of any type or other lethal or dangerous weapon.

27        Sec.  1.5. Checked baggage. It is unlawful for any person
28    to check or to have placed in a cargo hold of a commercial or
29    charter aircraft or to attempt to check or have placed  in  a
30    cargo  hold  of  a  commercial  or  charter  aircraft baggage

 1    containing an explosive or bomb of any  type  (other  than  a
 2    firecracker), a container holding poison or noxious gas, or a
 3    biological,   chemical,  or  radioactive  substance  if  that
 4    substance is likely to cause death or great  bodily  harm  to
 5    any person.

 7        Sec. 7. Sentence. Violation of paragraph (2) of Section 1
 8    or  Section 1.5 of this Act is a Class X felony. Violation of
 9    paragraph (1) of Section 1 of this Act is a Class  1  felony.
10    Violation  of  paragraph  (3)  of  Section 1 of this Act is a
11    Class 2 felony. Any other violation of this Act is a Class  A
12    misdemeanor.

14        Section  99.  Effective  date. This Act takes effect upon
15    becoming law.
