 1        AN ACT concerning campaign contributions.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5. The  Election  Code  is  amended  by  changing
 5    Section 9-25 and by adding Section 9-25.5 as follows:

 6        (10 ILCS 5/9-25) (from Ch. 46, par. 9-25)
 7        Sec.  9-25.  Anonymous contributions and contributions in
 8    the name of another person prohibited.
 9        (a)  No person shall make an anonymous contribution or  a
10    contribution  in  the  name  of another person, and no person
11    shall  knowingly  accept  any   anonymous   contribution   or
12    contribution  made  by  one  person  in  the  name of another
13    person.
14        (b)  Anonymous contributions  and  contributions  in  the
15    name  of  another  person  shall  escheat  to  the  State  of
16    Illinois.  Any  political  committee  that  receives  such  a
17    contribution  shall  forward  it  immediately  to  the  State
18    Treasurer.
19        (c)  Any   person   who   knowingly  makes  an  anonymous
20    contribution or a contribution in the name of another  person
21    is guilty of a Class A misdemeanor and may be fined an amount
22    no  greater  than  3  times  the  amount  of  the  prohibited
23    contribution.
24        (d)  For  the  purposes of this Section, "contribution in
25    the name of another person" means a contribution in which (i)
26    the source of the contribution and (ii) the person or  entity
27    causing  the  contribution  to be made are not reported under
28    this Article.

 1        Sec.  9-25.5.  Contributions   from   foreign   nationals
 2    prohibited.  No candidate or political committee may solicit,
 3    accept,  or  receive,  directly or indirectly, a contribution
 4    made by a foreign national. For the purposes of this Section,
 5    "foreign national"  means  (i)  a  government  of  a  foreign
 6    country  and a foreign political party; (ii) a person outside
 7    of the United States, unless it established that  the  person
 8    is  an  individual and a citizen of  and domiciled within the
 9    United States, or that the person is not an individual and is
10    organized under or created by the laws of the  United  States
11    or of any State or other place subject to the jurisdiction of
12    the  United  States  and  has its principal place of business
13    within the United States; (iii) a  partnership,  association,
14    corporation,  organization,  or  other combination of persons
15    organized under the laws of or having its principal place  of
16    business  in a foreign country; and (iv) an individual who is
17    not a citizen of the United States and who  is  not  lawfully
18    admitted  for  permanent  residence,  as  defined  in Section
19    1101(a)(20) of Title 8 of the United States Code.   The  term
20    "foreign  national"  does not include any individual who is a
21    citizen of the United States.

22        Section 99. Effective date.  This Act takes  effect  upon
23    becoming law.
