 1                    AMENDMENT TO HOUSE BILL 3247

 2        AMENDMENT NO.     .  Amend House Bill 3247,  AS  AMENDED,
 3    immediately  after  the  end  of  Section 40 by inserting the
 4    following:

 5        "Section 45. Upon the payment of the sum  of  $380.00  to
 6    the  State  of  Illinois,  and  subject to the conditions set
 7    forth in Section 900 of this Act, the  easement  for  highway
 8    purposes  acquired  by the People of the State of Illinois is
 9    released over and through the  following  described  land  in
10    Carroll County, Illinois:

11        Parcel No. 2DCA014

12        A  parcel  of  land  in  part  of  the  West  Half of the
13    Southeast Quarter of Section 12, Township 25 North,  Range  4
14    East  of  the  Fourth  Principal Meridian, County of Carroll,
15    State of Illinois, described as follows:
16        Commencing at the Center of Section 12;  thence  Easterly
17        on  the  North  Line  of  the  Southeast  Quarter of said
18        Section 12, said  line  having  a  bearing  of  North  82
19        degrees  19 minutes 02 seconds East, a distance of 406.36
20        feet to a point in the  Center  Line  of  a  public  road
21        designated  S.B.I.  Route  40  (Illinois  Route 78), said

 1        point being the Point of  Beginning  of  the  hereinafter
 2        described  parcel  of land; thence continuing Easterly on
 3        said North Line of the last described course, a  distance

 6        Southeasterly  on  said  Easterly Right-of-Way Line, said
 7        line having a bearing of South 21 degrees 23  minutes  35
 8        seconds  East,  a  distance  of  404.87  feet to a point;
 9        thence  continuing   Southeasterly   on   said   Easterly
10        Right-of-Way Line which is the arc of a circle concave to
11        the  Southwest,  an  arc distance of 33.70 feet, said arc
12        having a radius of 1,044.10 feet and a chord  bearing  of
13        South  20  degrees  29  minutes  01 seconds East, a chord
14        distance of 33.70 feet to a point; thence Southerly on  a
15        line  having  a  bearing of South 8 degrees 11 minutes 48
16        seconds West, a distance of 75.67 feet to a point in  the
17        Center  Line of said S.B.I. Route 40 (Illinois Route 78);
18        thence Northwesterly on said Center Line which is the arc
19        of a circle concave to the Southwest, an arc distance  of
20        99.66 feet, said arc having a radius of 1,011.10 feet and
21        a chord bearing of North 18 degrees 34 minutes 28 seconds
22        West,  a  chord distance of 99.62 feet to a point; thence
23        continuing Northwesterly on said Center Line,  said  line
24        having  a  bearing  of  North  21  degrees  23 minutes 35
25        seconds West, a distance of 412.92 feet to the  Point  of
26        Beginning, containing 0.360 acre, more or less.
27        For  the  purpose of this description, said North Line of
28        the Southeast Quarter of Section 12 has been  assigned  a
29        bearing of North 82 degrees 19 minutes 02 seconds East.

30        Section  50.  Upon the payment of the sum of $4,000.00 to
31    the State of Illinois, the easement for highway  purposes  is
32    released  over  and  through the following described land and
33    the rights or easement of access, crossing,  light,  air  and

 8    County, Illinois, more particularly described as follows:
 9        Commencing at the northwest corner of Outlot  24  in  the
10        Ninth  Addition  to McLean County Farm Bureau Subdivision
11        according to  Document  Number  99-38302  in  the  McLean
12        County  Recorder  Of  Deeds;  thence easterly 201.14 feet
13        along the southerly right of way line  of  Empire  Street
14        along  a  11,539.20  foot  radius curve to the left whose
15        chord bears North 87 degrees 04 minutes 00 seconds  East,
16        201.14  feet  to  the  Point  Of  Beginning of Release of
17        Access Control; thence easterly  98.00  feet  along  said
18        right  of way line along a 11,539.20 foot radius curve to
19        the left whose chord bears North 86 degrees 19 minutes 27

22    County, Illinois, more particularly described as follows:
23        Beginning at a point on the south line of  the  Northwest
24        Quarter  of  said  Section  22,  a distance of 50.00 feet
25        northwesterly  measured  at   right   angles   from   the
26        northwesterly  right  of way line of the C & NW Railroad,
27        formerly known as the Litchfield  and  Madison  Railroad;
28        thence   northeasterly   parallel   to   and  50.00  feet
29        northwesterly of said right of way line to a  point  that
30        is  145.00  feet  west of the centerline of highway FA 5;

22    Department of  Transportation  is  authorized  to  convey  by
23    quitclaim  deed  all  right, title and interest in and to the

21        Commencing  at  the Northeast Corner of Lot 1 of Dyroff's

23        Dupo  recorded  in Plat Book 27, Page 2 in the Recorder's
24        Office of St. Clair County, Illinois, said corner is also
25        located on the southerly existing right of  way  line  of

28    to permit requirements of the State of  Illinois,  Department

21    forth  in  Section  900 of this Act, the easement for highway
22    purposes acquired by the People of the State of  Illinois  is
23    released  over  and  through  the following described land in
24    Madison County, Illinois:

10    feet or 0.090 acre.

11        Exception:
12        It is understood and agreed that  there  is  no  existing
13        right  of  access  nor  will  access  be permitted in the
14        future  by  the  State   of   Illinois,   Department   of
15        Transportation, from or over the premises above described
16        to  and from FAP Route 789 (IL Rt. 3 and 111), previously
17        declared a freeway."; and

18    in Section 900, by replacing "pursuant to Sections 5  through
19    40" with "pursuant to Sections 5 through 85".
