 1        AN ACT concerning alcoholic liquor.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        (235 ILCS 5/8-12) (from Ch. 43, par. 164 3/4)
 5        Sec. 8-12.  It  shall  be  the  duty  of  every  railroad
 6    company,  express company, common or contract carrier, and of
 7    every person, firm or corporation that shall bring, carry  or
 8    transport  alcoholic  liquors  into the State of Illinois for
 9    delivery in said State or which are delivered in said  State,
10    to  prepare  and file with the Department of Revenue for each
11    month,  not  later  than  the  fifteenth  day  of  the  month
12    following that for which it is made, a report stating therein
13    the name of the company, carrier, person, firm or corporation
14    making the report, the  address  in  Illinois  at  which  the
15    records  supporting  such  report  are  kept  and are open to
16    inspection, the period of time covered by  said  report,  the
17    name and business address of each consignor of such alcoholic
18    liquors,  the  name and business address of each consignee of
19    such alcoholic liquors, the kind and  quantity  of  alcoholic
20    liquors delivered to each consignee, and the date or dates of
21    delivery. Such report shall be made upon forms prescribed and
22    made available by the Department and shall contain such other
23    information  as may reasonably be required by the Department.
24    The  Department  may  establish  procedures  for   electronic
25    transmissions of such information directly to the Department.
26    Such  reports or information received by the Department shall
27    be made available by the Department to  the  Commission  upon
28    the Commission's request.
29        In  addition  to  any other reporting requirement imposed
30    under this Section, reports shall be filed for  shipments  to
31    end   consumers  in  this  State.   In  furtherance  of  this
32    requirement, it shall be the duty of every railroad  company,

 1    express company, common or contract carrier, person, firm, or
 2    corporation  that  brings,  carries,  or transports alcoholic
 3    liquor into Illinois for delivery in Illinois  shall  prepare
 4    and  file  with the Department for each month, not later than
 5    the fifteenth day of the month  following  the  month  during
 6    which  the  delivery is made, a report containing the name of
 7    the company, carrier, person, firm, or corporation making the
 8    report,  the  address  in  Illinois  at  which  the   records
 9    supporting  the  report  are kept and are open to inspection,
10    the period of time  covered  by  the  report,  the  name  and
11    business  address  of each consignor of the alcoholic liquor,
12    the kind and quantity of alcoholic liquor delivered  to  each
13    consignee,  and  the date of delivery.  Such reports shall be
14    made upon forms prescribed and made  by  the  Department  and
15    shall  contain  any other information that the Department may
16    reasonably require.  Such reports or information received  by
17    the  Department  shall be made available by the Department to
18    the State Commission upon the State Commission's request.
19        The  books,  records,  supporting  papers  and  documents
20    containing information and  data  relating  to  such  reports
21    shall  be  kept  and  preserved  for a period of three years,
22    unless their destruction sooner is authorized, in writing, by
23    the Director, and shall be open and available  to  inspection
24    by  the  Director  of  Revenue  or the Commission or any duly
25    authorized officer, agent or employee of  the  Department  or
26    the  Commission,  at  all  times during business hours of the
27    day.
28        Any person who violates any of  the  provisions  of  this
29    section or any of the rules and regulations of the Department
30    for  the  administration and enforcement of the provisions of
31    this section is guilty of a Class C misdemeanor. In case of a
32    continuing violation each day's continuance thereof shall  be
33    a separate and distinct offense.
