 1        AN ACT concerning nursing home care.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Nursing  Home  Care  Act  is amended by
 5    changing Section 3-304.1 as follows:

 6        (210 ILCS 45/3-304.1)
 7        Sec. 3-304.1.  Public computer access to information.
 8        (a)  The  Department  must  make  information   regarding
 9    nursing  homes  in  the  State  available  to  the  public in
10    electronic form on the World Wide Web, including all  of  the
11    following information:
12             (1)  who regulates nursing homes;
13             (2)  information in the possession of the Department
14        that is listed in Sections 3-210 and 3-304;
15             (3)  deficiencies and plans of correction;
16             (4)  enforcement remedies;
17             (5)  penalty letters;
18             (6)  designation of penalty monies;
19             (7)  the   U.S.   Department  of  Health  and  Human
20        Services' Health Care  Financing  Administration  special
21        projects or federally required inspections;
22             (8)  advisory standards;
23             (9)  deficiency-free surveys; and
24             (10)  enforcement     actions     and    enforcement
25        summaries;.
26             (11)  information submitted under Sections 3-103 and
27        3-207, except information concerning the remuneration  of
28        personnel  licensed,  registered,  or  certified  by  the
29        Department of Professional Regulation and monthly charges
30        for an individual private resident;
31             (12)  records    of    license   and   certification

 1        inspections, surveys, and evaluations of a facility;
 2             (13)  reports   of   inspections,    surveys,    and
 3        evaluation of resident care;
 4             (14)  reports   concerning   a   facility   prepared
 5        pursuant  to  Titles XVIII and XIX of the Social Security
 6        Act and subject to the provisions of the Social  Security
 7        Act;
 8             (15)  cost  and reimbursement reports submitted by a
 9        facility under Section 3-208;
10             (16)  reports of an audit of a facility;
11             (17)  public records concerning costs  incurred  by,
12        revenues  received  by,  and reimbursement of a facility;
13        and
14             (18)  complaints filed against a  facility  and  the
15        complaint  investigation reports, after disclosure to the
16        facility as required under Section  3-702  and  excluding
17        the complainant's or resident's name.
18        (b)  No  fee  or  other  charge  may  be  imposed  by the
19    Department as a condition of accessing the information.
20        (c)  The electronic public access  provided  through  the
21    World  Wide  Web shall be in addition to any other electronic
22    or print distribution of the information.
23        (d)  The information shall be made available as  provided
24    in  this Section in the shortest practicable time after it is
25    publicly available in any other form.
