 1        AN ACT concerning environmental safety.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section   5.  The Environmental Protection Act is amended
 5    by changing Section 58 as follows:

 6        (415 ILCS 5/58)
 7        Sec. 58. Intent of Title.   It  is  the  intent  of  this
 8    Title:
 9             (1)  To establish a risk-based system of remediation
10        based  on  protection of human health and the environment
11        relative to present and future uses of the site.
12             (2)  To assure that the land use for which  remedial
13        action  was  undertaken  will  not  be  modified  without
14        consideration of the adequacy of such remedial action for
15        the new land use.
16             (3)  To provide incentives to the private sector  to
17        undertake  remedial action.
18             (4)  To  establish  expeditious alternatives for the
19        review of site  investigation  and  remedial  activities,
20        including a privatized review process.
21             (5)  To  assure  that the resources of the Hazardous
22        Waste Fund are used in a manner  that  is  protective  of
23        human  health and the environment relative to present and
24        future uses of the site and surrounding area.
25             (6)  To  provide  assistance  to  units   of   local
26        government  for remediation of properties contaminated or
27        potentially contaminated by  commercial,  industrial,  or
28        other  uses,  to  provide  loans for the redevelopment of
29        brownfields,  and  to  establish  and  provide  for   the
30        administration of the Brownfields Redevelopment Fund.
