 1        AN ACT concerning professional regulation.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Home  Medical  Equipment  and  Services
 5    Provider License Act is amended by  changing  Section  20  as
 6    follows:

 7        (225 ILCS 51/20)
 8        Sec. 20. Powers and duties of the Department.
 9        (a)  The  Department  must  shall exercise the powers and
10    duties  prescribed  by  the  Civil  Administrative  Code   of
11    Illinois  for  the  administration of licensure Acts and must
12    shall  exercise  other  powers  and  duties   necessary   for
13    effectuating the purposes of this Act.
14        (b)  The  Department  may  adopt  rules to administer and
15    enforce this Act, including  but  not  limited  to  fees  for
16    original  licensure  and renewal and restoration of licenses,
17    and may prescribe forms to be issued to implement  this  Act.
18    At  a minimum, the rules adopted by the Department must shall
19    include  standards  and  criteria  for  licensure   and   for
20    professional  conduct  and  discipline.  The  Department must
21    shall consult with the Board in  adopting  rules.  Notice  of
22    proposed  rulemaking  must shall be transmitted to the Board,
23    and the Department must shall review the Board's response and
24    any recommendations made in the response. The Department must
25    shall notify the Board in writing with proper explanation  of
26    deviations from the Board's recommendations and response.
27        (c)  The  Department  may at any time seek the advice and
28    expert knowledge of the Board on any matter relating  to  the
29    administration of this Act.
30        (d)  The  Department  must shall issue a quarterly report
31    to the Board of the status of all complaints related  to  the

 1    profession and filed with the Department.
