1 AN ACT concerning environmental protection.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended
5 by changing Section 13.2 as follows:
6 (415 ILCS 5/13.2) (from Ch. 111 1/2, par. 1013.2)
7 Sec. 13.2. Annual testing of private well water. At the
8 request of the owner or user of a private well, the Agency
9 shall provide for annual testing of water from private wells
10 located within 1/2 mile of any active or inactive sanitary
11 landfill or hazardous waste disposal facility at no charge to
12 the owner of the well.
13 Before obtaining a sample for testing, the Agency shall,
14 not less than 5 business days prior to obtaining the sample,
15 notify the owner or operator of the sanitary landfill or
16 hazardous waste disposal facility of the opportunity to
17 obtain a split sample and specify the sampling procedure,
18 testing procedure and analytical parameters to be evaluated.
19 Sample collection shall be conducted in cooperation with
20 the Illinois Department of Public Health and the recognized
21 local health department, where one exists, in whose
22 jurisdiction the well is located. The Illinois Department of
23 Public Health and the local health department shall be
24 provided with a written report of results upon completion of
25 sample testing.
