 1                     AMENDMENT TO HOUSE BILL 921

 2        AMENDMENT NO.     .  Amend House Bill 921 as follows:

 3    on page 1, in line 20, by deleting "Profession"; and

 4    on page 1, below line 20, by inserting the following:

 5        "Section 15.  The Interior Design Profession Title Act is
 6    amended by changing Sections 1, 4.5, and 8 as follows:

 8        Sec. 1.  Short title.  This  Act  may  be  cited  as  the
 9    Interior Design Profession Title Act.

12        Sec.   4.5.  Unregistered   practice;   violation;  civil
13    penalty.
14        (a)  Any  person  who  practices,  offers  to   practice,
15    attempts to practice, or holds himself or herself oneself out
16    to   be  practice  as  an  interior  designer  without  being
17    registered under this Act shall, in  addition  to  any  other
18    penalty   provided  by  law,  pay  a  civil  penalty  to  the
19    Department in an amount not to exceed $5,000 for each offense
20    as determined by the Department.  The civil penalty shall  be

 1    assessed  by  the  Department  after  a  hearing  is  held in
 2    accordance  with  the  provisions  set  forth  in  this   Act
 3    regarding  the provision of a hearing for the discipline of a
 4    licensee.
 5        (b)  The  Department  has  the  authority  and  power  to
 6    investigate any illegal use of the title of interior designer
 7    or residential interior designer and all unlicensed activity.
 8        (c)  The civil penalty shall be paid within 60 days after
 9    the effective date of the order imposing the  civil  penalty.
10    The  order  shall  constitute a judgment and may be filed and
11    execution had thereon in the same manner as any judgment from
12    any court of record.

15        Sec. 8.  Requirements for registration.
16        (a)  Each applicant for registration shall apply  to  the
17    Department  in  writing on a form provided by the Department.
18    Except as otherwise provided  in  this  Act,  each  applicant
19    shall   take   and  pass  the  examination  approved  by  the
20    Department.   Prior  to  registration,  the  applicant  shall
21    provide substantial evidence to the Board that the applicant:
22             (1)  is  a  graduate  of  a  5  year interior design
23        program from an accredited institution and has  completed
24        at least 2 years of full time diversified interior design
25        experience;
26             (2)  is  a  graduate  of  a  4  year interior design
27        program from an accredited institution and has  completed
28        at least 2 years of full time diversified interior design
29        experience;
30             (3)  has  completed  at  least  3  years of interior
31        design curriculum from an accredited institution and  has
32        completed  3  years  of  full  time  diversified interior
33        design experience;

 1             (4)  is a graduate  of  a  2  year  interior  design
 2        program  from an accredited institution and has completed
 3        4  years  of  full  time  diversified   interior   design
 4        experience; or
 5             (5)  holds  a  high  school  diploma  or GED and has
 6        completed 5 years of full  time  diversified  residential
 7        interior design experience.
 8        (b)  In  addition  to  providing  evidence of meeting the
 9    requirements of subsection (a):
10             (1)  Each applicant for registration as an  interior
11        designer  shall  provide  substantial evidence that he or
12        she   has   successfully   completed   the    examination
13        administered  by the National Council for Interior Design
14        Qualifications.
15             (2)   Each   applicant   for   registration   as   a
16        residential  interior  designer shall provide substantial
17        evidence that he or she has  successfully  completed  the
18        examination administered by the Council for Qualification
19        of   Residential  Interior  Designers  or  the  Certified
20        Kitchen   Designer   or   Certified   Bathroom   Designer
21        examination administered by the National Kitchen and Bath
22        Association.
23        Examinations for applicants under this Act may be held at
24    the direction of the Department from time  to  time  but  not
25    less  than  once  each  year.   The scope and form of any the
26    examination given under this Section  shall  conform  to  the
27    National    Council   for   Interior   Design   Qualification
28    examination for  interior  designers,  and  the  Council  for
29    Qualification   of   Residential   Interior   Designers   for
30    residential  interior  designers,  or  the  Certified Kitchen
31    Designer   or   Certified   Bathroom   Designer   examination
32    administered by the National Kitchen  and  Bath  Association,
33    whichever is applicable.
34        Each   applicant   for  registration  who  possesses  the

 1    necessary qualifications shall  pay  to  the  Department  the
 2    required registration fee, which is not refundable.
 3        An  individual  applying  for  registration  shall have 3
 4    years  from  the  date  of  application   to   complete   the
 5    application process. If the process has not been completed in
 6    3  years,  the  application  shall  be  denied  and  the  fee
 7    forfeited.  The  applicant  may  reapply,  but shall meet the
 8    requirements in effect at the time of reapplication.
 9        (c)  If any applicant applies  for  registration  between
10    January  1,  1993, and January 31, 1993, and had completed by
11    June 30, 1992 at least 8  years  of  full  time,  diversified
12    professional  experience  in interior design or a combination
13    of full time experience  and  interior  design  education  to
14    equal  8  years, the applicant may be issued a certificate of
15    registration without examination.   Registration  under  this
16    subsection  shall  be  subject  to  the Board's discretionary
17    review of the experience qualification.
18        Notwithstanding any other provisions in this Act,  anyone
19    who  has  submitted  an  application  within 5 days after the
20    effective date  of  this  amendatory  Act  of  1994  and  has
21    completed   at  least  15  years  of  full-time,  diversified
22    professional experience in interior design may  be  issued  a
23    certificate of registration without examination.
24        (c-5)  If  any  applicant  applies  for registration as a
25    residential interior  designer  within  one  year  after  the
26    effective  date  of  this  amendatory  Act  of  1994  and has
27    completed  at  least  5  years  of  full  time,   diversified
28    professional  experience  in residential interior design or a
29    combination of full time experience and residential  interior
30    design  education  equal  to  5  years,  the applicant may be
31    issued a certificate  of  registration  without  examination.
32    Registration  under  this  subsection shall be subject to the
33    Board's discretionary review of the experience qualification.
34        (d)  Upon payment of the required  fee,  which  shall  be

 1    determined by rule, an applicant who is an architect licensed
 2    under  the  laws  of  this State may, without examination, be
 3    granted registration as an interior designer  or  residential
 4    interior  designer  by  the Department provided the applicant
 5    submits proof of an active architectural license in Illinois.
 6        (e)  An interior designer registered under  the  laws  of
 7    this  State  may,  without examination or re-application, use
 8    the title "Residential Interior Designer".
