1 AN ACT relating to public utilities.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Public Utilities Act is amended by adding
5 Section 8-600 as follows:
6 (220 ILCS 5/8-600 new)
7 Sec. 8-600. Reliability of facilities; enforcement. The
8 Commission, after notice and hearing held on complaint or on
9 the Commission's motion, has authority to:
10 (1) order a public utility to correct any
11 inadequacy in service reliability in violation of or
12 non-conformance with the provisions of this Act or
13 Commission rules, including orders to perform specific
14 remedial actions by specified dates;
15 (2) impose financial penalties for violations of or
16 non-conformances with the provisions of this Act or
17 Commission rules respecting reliability, not to exceed
18 (i) $10,000 per occurrence or (ii) $30,000 per day for
19 those violations or non-conformances that continue after
20 the deadline for correction established in a Commission
21 order to correct a reliability deficiency; and
22 (3) alter, modify, revoke, or suspend the
23 certificate of service authority of a public utility for
24 substantial or repeated violations of or non-conformances
25 with the provisions of this Act or Commission rules
26 respecting reliability.
27 Section 99. Effective date. This Act takes effect upon
28 becoming law.
