 1        AN ACT in relation to environmental safety.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The Environmental Protection Act is amended
 5    by changing Section 9.2 as follows:

 6        (415 ILCS 5/9.2) (from Ch. 111 1/2, par. 1009.2)
 7        Sec. 9.2.  Sulfur  dioxide  emission  standards;  review;
 8    amendments.
 9        (a)  The  Agency shall review all Illinois sulfur dioxide
10    emission standards for existing  fuel  combustion  stationary
11    emission  sources  located  within  the  Chicago,  St.  Louis
12    (Illinois),  and  Peoria  major  metropolitan  areas  and, if
13    appropriate following such review, propose amendments to such
14    standards to the Board by July 1, 1980, or within 90 days  of
15    receipt  of  the initial reports required pursuant to Section
16    6.1 of this Act, whichever is later.  The standards  proposed
17    by  the  Agency  shall  be  designed  to  enhance  the use of
18    Illinois  coal,  consistent  with  the  need  to  attain  and
19    maintain the  National  Ambient  Air  Quality  Standards  for
20    sulfur dioxide and particulate matter.
21        (b)  In  granting  any  alternative  emission standard or
22    variance  relating  to  sulfur  dioxide  emissions   from   a
23    coal-burning stationary source, the Board may require the use
24    of  Illinois coal as a condition of such alternative standard
25    or variance, provided that the Board determines that Illinois
26    coal of the proper quality is available  and  competitive  in
27    price;  such determination shall include consideration of the
28    cost of pollution control equipment and the  economic  impact
29    on the Illinois coal mining industry.
