 1        AN ACT in relation to public employee benefits.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Illinois  Pension  Code  is amended by
 5    changing Section 4-109.2 as follows:

 6        (40 ILCS 5/4-109.2) (from Ch. 108 1/2, par. 4-109.2)
 7        Sec. 4-109.2.  Minimum pension.
 8        (a)  Beginning January 1, 1984,  the  minimum  disability
 9    pension  granted  under  Section  4-110 or 4-111, the minimum
10    surviving  spouse's  pension,  and  the  minimum   retirement
11    pension  granted  to  a  firefighter with 20 or more years of
12    creditable service, shall be $300 per month,  without  regard
13    to  whether  the  death,  disability  or  retirement  of  the
14    firefighter occurred prior to that date.
15        Beginning  July  1,  1987, the minimum retirement pension
16    payable to a firefighter with 20 or more years of  creditable
17    service, the minimum disability pension payable under Section
18    4-110  or  4-111,  and the minimum surviving spouse's pension
19    shall be $400 per month, without regard to whether the death,
20    retirement or disability of the firefighter occurred prior to
21    that date.
22        Beginning July 1, 1993, the  minimum  retirement  pension
23    payable  to a firefighter with 20 or more years of creditable
24    service and the minimum surviving spouse's pension  shall  be
25    $475 per month, without regard to whether the firefighter was
26    in  service on or after the effective date of this amendatory
27    Act of 1993.
28        (b)  Beginning January 1, 1999,  the  minimum  retirement
29    pension  payable  to  a  firefighter with 20 or more years of
30    creditable service, the minimum  disability  pension  payable
31    under  Section  4-110,  4-110.1,  or  4-111,  and the minimum

 1    surviving spouse's pension shall be $600 per  month,  without
 2    regard  to whether the firefighter was in service on or after
 3    the effective date of this amendatory Act of the 91st General
 4    Assembly.
 5        In the case of a pensioner whose pension began before the
 6    effective date of this  amendatory  Act  and  is  subject  to
 7    increase  under  this  subsection (b), the pensioner shall be
 8    entitled to a lump sum payment of the amount of that increase
 9    accruing from January 1, 1999 (or the date the pension began,
10    if later) to the effective date of this amendatory Act.
11        (c)  Beginning January 1, 2000,  the  minimum  retirement
12    pension  payable  to  a  firefighter with 20 or more years of
13    creditable service, the minimum  disability  pension  payable
14    under  Section  4-110,  4-110.1,  or  4-111,  and the minimum
15    surviving spouse's pension shall be $800 per  month,  without
16    regard  to whether the firefighter was in service on or after
17    the effective date of this amendatory Act of the 91st General
18    Assembly.
19        (d)  Beginning January 1, 2001,  the  minimum  retirement
20    pension  payable  to  a  firefighter with 20 or more years of
21    creditable service, the minimum  disability  pension  payable
22    under  Section  4-110,  4-110.1,  or  4-111,  and the minimum
23    surviving spouse's pension shall be $1000 per month,  without
24    regard  to whether the firefighter was in service on or after
25    the effective date of this amendatory Act of the 91st General
26    Assembly.
27        (e)  The  minimum  retirement  pension   payable   to   a
28    firefighter  with 20 or more years of creditable service, the
29    minimum  disability  pension  payable  under  Section  4-110,
30    4-110.1, or 4-111, and the minimum surviving spouse's pension
31    that are specified in subsection (d) shall each be  increased
32    by 3% on January 1, 2002 and by an additional 3% (compounded)
33    on  each January 1 thereafter.  These increases apply without
34    regard  to  whether  the  retired,  disabled,   or   deceased

 1    firefighter  was in service on or after the effective date of
 2    this amendatory Act of the 92nd General Assembly.

 4        Section 90.  The State Mandates Act is amended by  adding
 5    Section 8.25 as follows:

 6        (30 ILCS 805/8.25 new)
 7        Sec.  8.25.  Exempt  mandate.  Notwithstanding Sections 6
 8    and 8 of this Act, no reimbursement by the State is  required
 9    for  the  implementation  of  any  mandate  created  by  this
10    amendatory Act of the 92nd General Assembly.

11        Section  99.  Effective date.  This Act takes effect upon
12    becoming law.
