 1                     AMENDMENT TO HOUSE BILL 86

 2        AMENDMENT NO.     .  Amend House Bill 86 on page 4,  line
 3    14, after "maintain.", by inserting the following:
 4    "The Department of Public Aid is exempt from the requirements
 5    of  this  subsection  with regard to child support debts, the
 6    collection of which is governed by the requirements of  Title
 7    IV,   Part  D  of  the  federal  Social  Security  Act.   The
 8    Department of Public Aid may refer child support  debts  more
 9    than  90 days overdue to the State to the Unit.  In the event
10    a child support debt is  referred to the Unit, the Unit  must
11    use any appropriate means for collection of the debt that are
12    normally  available  to  the Unit under State law.  The debt,
13    however, remains an obligation owed under the  Department  of
14    Public Aid's Child Support Enforcement Program subject to the
15    requirements  of  Title  IV,  Part  D  of  the federal Social
16    Security  Act,  including  the  continued  use  of  federally
17    mandated  enforcement  remedies   and   techniques   by   the
18    Department of Public Aid."; and

19    on   page  8,  line  21,  after  "Unit.",  by  inserting  the
20    following:
21    "The Department of Public Aid is exempt from the requirements
22    of this subsection with regard to  child  support  debts  the
23    collection  of which is governed by the requirements of Title

 1    IV,  Part  D  of  the  federal  Social  Security  Act.    The
 2    Department  of  Public Aid may refer child support debts more
 3    than 90 days overdue to the State to the Unit.  In the  event
 4    a  child support debt is  referred to the Unit, the Unit must
 5    use any appropriate means for collection of the debt normally
 6    available to the Unit under State law.   The  debt,  however,
 7    remains  an  obligation  owed  under the Department of Public
 8    Aid's  Child  Support  Enforcement  Program  subject  to  the
 9    requirements of Title  IV,  Part  D  of  the  federal  Social
10    Security  Act,  including  the  continued  use  of  federally
11    mandated   enforcement   remedies   and   techniques  by  the
12    Department of Public Aid."; and

13    on  page  8,  line  31,  after  "Fund.",  by  inserting   the
14    following:
15    "The  provisions of this subsection do not apply to any child
16    support debt referred to the Unit by the Department of Public
17    Aid under this Section or Section 5.   Collections  resulting
18    from  the  referrals must be distributed and disbursed at the
19    direction of the Department of Public Aid in accordance  with
20    the  requirements  of  Title IV, Part D of the federal Social
21    Security Act, applicable provisions of  State  law,  and  the
22    rules of the Department of Public Aid.".
