Short description: 
CIV PRO-SMALL CLAIM-TENDER                                                 

Synopsis of Bill as introduced:
        Amends the Code of Civil Procedure concerning "pre-trial  steps".      
   Provides that in an action based on contract that qualifies as a small      
   claim  under  the  Supreme  Court  Rules,  if  the  contract  does not      
   otherwise provide for attorney's fees and costs, then the party who is      
   determined to be  the  party  prevailing  on  the  contract  shall  be      
   entitled to reasonable attorney's fees in addition to costs.  Provides      
   that  reasonable  attorney's  fees  shall  not  exceed  (i) 25% of the      
   principal obligation alleged to have been owed under the  contract  if      
   the  defendant  prevails  or  (ii)  25%  of  the  principal obligation      
   included in the judgment, if the plaintiff prevails.
