DURKIN-DART-JOHNSON,TIM. (HAWKINSON-NOLAND-SHADID) 725 ILCS 5/115-10.4 new Amends the Code of Criminal Procedure of 1963. Permits hearsay statements of deceased persons to be admitted into evidence if the statements are not covered by other hearsay exceptions but have equivalent circumstantial guarantees of trustworthiness and certain other conditions are met. Effective immediately. HOUSE AMENDMENT NO. 1. Provides that unavailability as a witness is limited to the situation in which the declarant is deceased.
