 1                       SENATE JOINT RESOLUTION

 2        WHEREAS, On November 23, 1998, the Attorneys  General  of
 3    46  states  (including  Illinois), Puerto Rico, the US Virgin
 4    Islands, American Samoa, the Northern Mariana  Islands,  Guam
 5    and  the  District  of  Columbia signed an agreement with the
 6    five  largest  Tobacco  manufacturers  (Brown  &   Williamson
 7    Tobacco corporation, Lorillard Tobacco Company, Philip Morris
 8    Incorporated   RJ   Reynolds  Tobacco  Company,  Commonwealth
 9    Tobacco and Liggett & Myers)  settling  the  four-year  legal
10    battle over tobacco, public health and youth safety; and

11        WHEREAS,  Pursuant  to  this  agreement, between 1998 and
12    2025,  states  will  receive  over  $206  billion  from   the
13    settlement,  with  Illinois'  share reaching over $9 billion;
14    and

15        WHEREAS, The settlement contains no restrictions  on  the
16    use of the moneys; and

17        WHEREAS,  Initial  projections  for  the tobacco payments
18    have been significantly decreased  due  to  shrinking  market
19    demand and other underestimated offsets; and

20        WHEREAS,  Lawsuits  have  been filed against the State of
21    Illinois asserting  a  claim  for  portions  of  the  tobacco
22    settlement moneys; and

23        WHEREAS,  These  many  factors  make  the  future  of the
24    tobacco settlement payments uncertain; and

25        WHEREAS, The State has yet to form a unified future  plan
26    for expenditure of the tobacco moneys; and

27        WHEREAS,  Effects of tobacco have impacted persons from a
28    variety of backgrounds and experiences; therefore, be it

29        RESOLVED, BY  THE  SENATE  OF  THE  NINETY-FIRST  GENERAL
30    ASSEMBLY   OF   THE   STATE   OF   ILLINOIS,   THE  HOUSE  OF

 1    REPRESENTATIVES CONCURRING HEREIN, That there is created  the
 2    Illinois  Task  Force  on  Tobacco and Health Care; and be it
 3    further

 4        RESOLVED,  That  the  Task  Force  shall  consist  of  14
 5    members:

 6        (1)  Four legislative members, one appointed by each  the
 7    President of the Senate, the Speaker of the House, the Senate
 8    Minority Leader and the Minority Leader of the House,

 9        (2)  One doctor currently engaged in the private practice
10    of medicine, appointed by the Illinois State Medical Society,

11        (3)  One  teacher,  appointed  by  the Illinois Education
12    Association,

13        (4)  One researcher, currently engaged in  health-related
14    research, appointed by the University of Illinois,

15        (5)  One  student,  appointed by the State Superintendent
16    of Education,

17        (6)  One member of the business community,  appointed  by
18    the Chamber of Commerce,

19        (7)  One working individual, appointed by the AFL-CIO,

20        (8)  One   banker   actively   engaged   in  the  banking
21    profession, appointed by the Illinois Bankers Association,

22        (9)  One parent, appointed by the  Illinois  Congress  of
23    Parents and Teachers, and

24        (10)  One senior citizen, appointed by AARP,

25        (11)  One  representative  appointed by the Department of
26    Public Health; and be it further

27        RESOLVED, That the legislators appointed by the President

 1    of the Senate and the Speaker of the  House  shall  serve  as
 2    co-chairpersons of the Task Force; and be it further

 3        RESOLVED,  That  the Task Force shall meet at the call of
 4    the Chairs; and be it further

 5        RESOLVED, That members shall serve without  compensation;
 6    and be it further

 7        RESOLVED,  That the Task Force provide recommendations to
 8    the General Assembly on how to allocate  Illinois'  share  of
 9    the Master Settlement Agreement funds; and be it further

10        RESOLVED,   That   the   Task   Force   shall  issue  its
11    recommendations on or before January 9, 2001.
