 1        AN ACT to amend the  Sanitary  Food  Preparation  Act  by
 2    adding Section 10.05.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The Sanitary Food Preparation Act is  amended
 6    by adding Section 10.05  as follows:

 7        (310 ILCS 650/10.05 new)
 8        Sec. 10.05.  Food service employees; hepatitis.
 9        (a)  In  this Section, "food service establishment" means
10    any place where food is prepared and intended for, though not
11    limited to, individual portion service and includes  the site
12    at which individual portions are provided.  The term includes
13    any such place  regardless of whether consumption  is  on  or
14    off the premises and regardless of whether  there is a charge
15    for  the  food.   The  term  also  includes delicatessen type
16    operations  that    prepare  foods  intended  for  individual
17    portion service.  The term does  not  include  (i)    lodging
18    facilities  serving only a continental breakfast (a breakfast
19    limited to only coffee,  tea, or juice, or any combination of
20    those, and commercially prepared sweet baked    goods),  (ii)
21    private  homes  or  closed  family  functions  where  food is
22    prepared or served for  individual family consumption,  (iii)
23    retail  food  stores,  or  (iv)  the location of food vending
24    machines.
25        (b)  An owner, operator, or manager  of  a  food  service
26    establishment  may not  require or permit a person to perform
27    any task as a food handler in that establishment  unless that
28    person has been immunized against hepatitis  A  virus  within
29    the preceding 12  months.
30        (c)  A  person may not perform any task as a food handler
31    in a food service  establishment unless the person  has  been

 1    immunized  against hepatitis A virus within the  preceding 12
 2    months.
 3        (d)  An owner, operator, or manager  of  a  food  service
 4    establishment  who  violates  subsection  (b)  is guilty of a
 5    petty offense punishable by a fine of not more than $1,000. A
 6    person who performs any task as a  food  handler  in  a  food
 7    service  establishment    in  violation  of subsection (c) is
 8    guilty of a petty offense punishable by a fine  of  not  more
 9    than $500.
