 1        AN ACT to amend the Illinois Public Aid  Code  by  adding
 2    Section 10-26.5.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5. The Illinois Public Aid  Code  is  amended  by
 6    adding Section 10-26.5 as follows:

 7        (305 ILCS 5/10-26.5 new)
 8        Sec.  10-26.5.  Delayed  payment  from State Disbursement
 9    Unit.
10        (a) In this Section,  "adversely  affected  recipient  of
11    support"  means  a  person  who  meets  all  of the following
12    criteria:
13             (1) The person is  entitled  to  disbursement  of  a
14        child support payment from the State Disbursement Unit.
15             (2)  The person either (i) does not receive from the
16        State Disbursement Unit a disbursement of a child support
17        payment to which he or she is entitled or (ii) receives a
18        delayed disbursement of a child support payment from  the
19        State Disbursement Unit.
20             (3)   As   a   result   of  the  nonreceipt  of  the
21        disbursement of the child support payment or the  delayed
22        disbursement  of  the  child  support payment, the person
23        receives an adverse rating by a credit  reporting  agency
24        based,  for  example, on the person's inability to make a
25        timely payment of an amount owed to another person.
26        (b)  Upon the request of an adversely affected  recipient
27    of  support,  the  Illinois Department shall send a letter to
28    the recipient verifying  the  delayed  or  undisbursed  child
29    support payment.  The recipient may submit that letter to the
30    appropriate  credit  reporting  agency  for  placement in the
31    recipient's credit file.

 1        (c)  The Illinois Department shall adopt rules  necessary
 2    to implement this Section.

 3        Section  99.  Effective date.  This Act takes effect upon
 4    becoming law.
