 1        AN ACT concerning fire protection districts.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The Fire Protection District Act is amended
 5    by adding Section 25.4 as follows:

 6        (70 ILCS 705/25.4 new)
 7        Sec. 25.4. Ordinance violations; penalties.
 8        (a)  The  board  of  trustees  of  any  fire   protection
 9    district  incorporated under this Act may, in connection with
10    the passage  by  the  board  of  trustees  of  any  ordinance
11    authorized  by this Act or other law, make a violation of the
12    ordinance a petty offense punishable by the imposition  of  a
13    civil fine not to exceed $750.
14        (b)  The   board  of  trustees  of  any  fire  protection
15    district may, in connection with the passage by the board  of
16    trustees  of  any  ordinance  authorized by this Act or other
17    law,  make  a  violation  of  the  ordinance  a   misdemeanor
18    punishable by incarceration in a penal institution other than
19    the penitentiary not to exceed 6 months.  The fire protection
20    district  is  authorized  to  prosecute  violations  of penal
21    ordinances enacted under the authority of this subsection  as
22    criminal  offenses  by  its corporate attorney in the circuit
23    court by an information or by a sworn complaint charging  the
24    offense.   The  prosecution  must  conform  to  the  rules of
25    criminal procedure.  To convict, the district must  establish
26    the guilt of the defendant beyond a reasonable doubt.
27        (c)  The  penalty  imposed  for violation of an ordinance
28    authorized by this Act or other law and adopted by the  board
29    of  trustees of a fire protection district incorporated under
30    this Act may include, or consist of, a requirement  that  the
31    defendant perform some reasonable public service work.
