1 AN ACT to amend the Illinois Vehicle Code by adding
2 Section 11-212.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 adding Section 11-212 as follows:
7 (625 ILCS 5/11-212 new)
8 Sec. 11-212. Roadside safety stops without probable
9 cause prohibited.
10 (a) A police officer may not conduct a roadside safety
11 check of a motor vehicle without probable cause that the
12 driver of the vehicle has violated a provision of this Code
13 or a similar provision of a local ordinance. Any evidence
14 obtained against the driver who was stopped in violation of
15 this Section is inadmissible in any prosecution of a
16 violation of this Code or of a similar violation of a local
17 ordinance.
18 (b) In this Section, "roadside safety check" means the
19 stopping of each motor vehicle by a police officer at a
20 particular location without probable cause for the purpose of
21 determining whether the driver of the vehicle has committed a
22 violation of this Code or a similar provision of a local
23 ordinance.
