 1                    AMENDMENT TO SENATE BILL 968

 2        AMENDMENT NO.     .  Amend Senate Bill 968,  AS  AMENDED,
 3    by  replacing  everything  after the enacting clause with the
 4    following:

 5        "Section 5.  The Renewable Energy, Energy Efficiency, and
 6    Coal Resources Development Law of 1997 is amended by changing
 7    6-6 as follows:

 8        (20 ILCS 687/6-6)
 9        (Section scheduled to be repealed on December 16, 2007)
10        Sec. 6-6. Energy efficiency program.
11        (a)  For the year beginning January  1,  1999  1998,  and
12    thereafter as provided in this Section, each electric utility
13    as  defined  in Section 3-105 of the Public Utilities Act and
14    each alternative  retail  electric  supplier  as  defined  in
15    Section 16-102 of the Public Utilities Act supplying electric
16    power  and energy to retail customers located in the State of
17    Illinois shall contribute annually a  pro  rata  share  of  a
18    total  amount of $10,000,000 $3,000,000 based upon the number
19    of kilowatt-hours sold by each such entity in the  12  months
20    preceding  the  year  of contribution.  On or before May 1 of
21    each year, the Illinois Commerce Commission  shall  determine
22    and  notify  the Department of Commerce and Community Affairs

 1    of the pro rata share owed by each electric utility and  each
 2    alternative  retail  electric supplier based upon information
 3    supplied annually to the Illinois Commerce Commission.  On or
 4    before June 1 of each year, the Department  of  Commerce  and
 5    Community  Affairs  shall  send  written notification to each
 6    electric  utility  and  each  alternative   retail   electric
 7    supplier  of  the  amount  of  pro rata share they owe. These
 8    contributions shall be remitted to the Department of  Revenue
 9    on  or before June 30 of each year the contribution is due on
10    a return  prescribed  and  furnished  by  the  Department  of
11    Revenue showing such information as the Department of Revenue
12    may  reasonably require.  The funds received pursuant to this
13    Section shall be subject to the appropriation of funds by the
14    General Assembly.  The Department of Revenue shall place  the
15    funds  remitted  under  this Section in a trust fund, that is
16    hereby created in  the  State  Treasury,  called  the  Energy
17    Efficiency  Trust Fund. If an electric utility or alternative
18    retail electric supplier does not remit its pro rata share to
19    the Department of Revenue, the  Department  of  Revenue  must
20    inform the Illinois Commerce Commission of such failure.  The
21    Illinois    Commerce   Commission   may   then   revoke   the
22    certification of that electric utility or alternative  retail
23    electric  supplier.  The Illinois Commerce Commission may not
24    renew  the  certification  of   any   electric   utility   or
25    alternative  retail  electric  supplier that is delinquent in
26    paying its pro rata share.
27        (b)  The Department of  Commerce  and  Community  Affairs
28    shall disburse the moneys in the Energy Efficiency Trust Fund
29    to  residential electric customers to fund projects which the
30    Department of Commerce and Community Affairs  has  determined
31    will promote energy efficiency in the State of Illinois.  The
32    Department  of Commerce and Community Affairs shall establish
33    a list of  projects  eligible  for  grants  from  the  Energy
34    Efficiency   Trust   Fund  including,  but  not  limited  to,

 1    supporting   energy   efficiency   efforts   for   low-income
 2    households, replacing energy inefficient  windows  with  more
 3    efficient  windows,  replacing  energy inefficient appliances
 4    with more efficient appliances, replacing energy  inefficient
 5    lighting  with  more efficient lighting, insulating dwellings
 6    and buildings, and such other projects  which  will  increase
 7    energy efficiency in homes and rental properties.
 8        (c)  The  Department  of  Commerce  and Community Affairs
 9    shall establish criteria and an application process for  this
10    grant program.
11        (d)  The  Department  of  Commerce  and Community Affairs
12    shall conduct a study of  other  possible  energy  efficiency
13    improvements   and  evaluate  methods  for  promoting  energy
14    efficiency and conservation, especially for  the  benefit  of
15    low-income customers.
16        (e)  The  Department  of  Commerce  and Community Affairs
17    shall  submit  an  annual  report  to  the  General  Assembly
18    evaluating the effectiveness of  the  projects  and  programs
19    provided   in   this   Section,   and   recommending  further
20    legislation which will encourage additional  development  and
21    implementation  of energy efficiency projects and programs in
22    Illinois and other actions that help to  meet  the  goals  of
23    this Section.

25        Section  99.  Effective date.  This Act takes effect upon
26    becoming law.".
