1 AN ACT to amend the Mental Health and Developmental
2 Disabilities Administrative Act by adding Section 15.4.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Mental Health and Developmental
6 Disabilities Administrative Act is amended by adding Section
7 15.4 as follows:
8 (20 ILCS 1705/15.4 new)
9 Sec. 15.4. Medication aide authorization, training, and
10 supervision. The Department of Human Services is authorized
11 to supervise the development of a training program for
12 medication aides that includes following written instructions
13 for medication distribution prepared by a nurse, recognizing
14 commonly distributed oral and topical medications, knowing
15 program emergency procedures in case of an adverse reaction
16 to medication, and maintaining records of distribution of
17 those medications. Trained medication aides are authorized
18 to distribute oral and topical medications under the
19 supervision of a nurse as prescribed by a physician in
20 privately operated programs for persons with developmental
21 disabilities as certified or licensed by the Department of
22 Human Services or by the Department of Public Health.
23 Programs using medication aides are responsible for
24 documenting and maintaining records on the training completed
25 for each medication aide.
26 Section 99. Effective date. This Act takes effect upon
27 becoming law.
