 1        AN  ACT  to  amend  the  Election  Code by adding Section
 2    29-21.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.  The  Election  Code  is  amended  by  adding
 6    Section 29-21 as follows:
 7        (10 ILCS 5/29-21 new)
 8        Sec.  29-20.  (a)  No  person,  during  the course of any
 9    campaign for nomination  or  election  to  public  office  or
10    office  of  a  political  party,  shall  by means of campaign
11    material, including but not limited to  a  sample  ballot,  a
12    television   or  radio  commercial,  an  advertisement  in  a
13    newspaper or periodical, a public speech or a press  release,
14    purposely do any of the following:
15        (1)  Use  the  title of an office not currently held by a
16    candidate in a manner that implies  the  candidate  currently
17    holds  that  office,  or  use  the  term  "re-elect" when the
18    candidate has never been elected at a primary, or  a  general
19    or  special  election,  to  the  office  for  which  he  is a
20    candidate;
21        (2)  Make  a  false  statement  concerning   the   formal
22    schooling  or training completed or attempted by a candidate;
23    a degree, diploma, certificate,  scholarship,  grant,  award,
24    prize  or  honor  received, earned or held by a candidate; or
25    the period of time during  which  a  candidate  attended  any
26    school, college, community technical school or institution;
27        (3)  Make  a false statement concerning the professional,
28    occupational or vocational licenses held by a  candidate,  or
29    concerning  any  position the candidate has held for which he
30    received a salary or wages;
31        (4)  Falsely state that a candidate  or  public  official
32    has  been indicted or convicted of a theft offense, extortion

 1    or  other  crime  involving  financial  corruption  or  moral
 2    turpitude;
 3        (5)  Falsely state that a candidate has been indicted for
 4    any  crime  without  disclosing  the  outcome  of  any  legal
 5    proceedings resulting from the indictment;
 6        (6)  Falsely state that a candidate  or  official  has  a
 7    record of treatment or confinement for mental disorder;
 8        (7)  Falsely  state that a candidate or official has been
 9    subjected to military discipline for criminal  misconduct  or
10    dishonorably discharged from the armed services;
11        (8)  Falsely  identify  the  source of a statement, issue
12    statements  under  the  name  of   another   person   without
13    authorization,   or  falsely  state  the  endorsement  of  or
14    opposition to a candidate by a person or publication;
15        (9)  Make a false statement concerning the voting  record
16    of a candidate or public official; or
17        (10)  Post, publish, circulate or distribute a written or
18    printed  false statement, either knowing the same to be false
19    or with reckless disregard of whether it  is  false  or  not,
20    concerning  a  candidate  that  is  designed  to  promote the
21    election, nomination or defeat of the candidate.
22        (b)  A person who violates subsection (a) commits a petty
23    offense.
