1 AN ACT to amend the Nursing Home Care Act by adding
2 Sections 3-808 and 3-809.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Nursing Home Care Act is amended by
6 adding Sections 3-808 and 3-809 as follows:
7 (210 ILCS 45/3-808 new)
8 Sec. 3-808. Liability to residents. The State is liable
9 to a resident for any intentional act or omission of one of
10 its agents or employees that causes an injury to the resident
11 or aggravates an injury of a resident.

13 Sec. 3-809. Misrepresentation.
14 (a) The State shall not indemnify any employee who,
15 intentionally or with reckless disregard for the truth,
16 misrepresents or fails to accurately portray the conditions
17 in a long-term care facility during an inspection or survey.
18 (b) Any employee who, intentionally or with reckless
19 disregard for the truth, misrepresents or fails to accurately
20 portray the conditions in a long-term care facility during an
21 inspection or survey shall be personally liable damages that
22 result from the misrepresentation or failure to accurately
23 portray the conditions in a long-term care facility during an
24 inspection or survey.
25 Section 99. Effective date. This Act takes effect upon
26 becoming law.
