 1        AN ACT regarding treatment of prostate cancer.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Civil Administrative Code of Illinois  is
 5    amended by changing Section 55.90 as follows:

 6        (20 ILCS 2310/55.90)
 7        Sec.  55.90.   Prostate  and  testicular cancer awareness
 8    program.
 9        (a)  The  Department  of  Public   Health,   subject   to
10    appropriation  or  other  available  funding, shall conduct a
11    program to promote awareness and early detection of  prostate
12    and testicular cancer.  The program may include, but need not
13    be limited to:
14             (1)  dissemination   of  information  regarding  the
15        incidence of prostate and  testicular  cancer,  the  risk
16        factors  associated  with prostate and testicular cancer,
17        and the benefits of early detection and treatment;
18             (2)  promotion of information and  counseling  about
19        treatment options; and
20             (3)  establishment   and   promotion   of   referral
21        services and screening programs.
22        (b)  Subject to appropriation or other available funding,
23    a  Prostate  Cancer Screening Program shall be established in
24    the Department of Public Health.
25             (1) The Program shall apply to the following persons
26        and entities:
27                  (A)  uninsured and underinsured men 50 years of
28             age and older;
29                  (B)  uninsured and underinsured men between  40
30             and  50  years  of  age  who  are  at  high risk for
31             prostate cancer, upon the advice of a  physician  or

 1             upon the request of the patient; and
 2                  (C)  non-profit     organizations     providing
 3             assistance to persons described in subparagraphs (A)
 4             and (B).
 5             (2)  Any   entity   funded   by  the  Program  shall
 6        coordinate with other local providers of prostate  cancer
 7        screening,  diagnostic, followup, education, and advocacy
 8        services to avoid  duplication  of  effort.   Any  entity
 9        funded  by  the  Program shall comply with any applicable
10        State and federal  standards  regarding  prostate  cancer
11        screening.
12             (3)  Administrative  costs  of  the Department shall
13        not exceed 10% of the funds  allocated  to  the  Program.
14        Indirect  costs  of  the  entities funded by this Program
15        shall  not  exceed  12%.   The  Department  shall  define
16        "indirect costs" in accordance with applicable State  and
17        federal law.
18             (4)  Any  entity funded by the Program shall collect
19        data and maintain records  that  are  determined  by  the
20        Department to be necessary to facilitate the Department's
21        ability  to monitor and evaluate the effectiveness of the
22        entities and the Program. Commencing with  the  Program's
23        second  year of operation, the Department shall submit an
24        Annual Report to the General Assembly and  the  Governor.
25        The    report   shall   describe   the   activities   and
26        effectiveness of the Program and shall include,  but  not
27        be   limited  to,  the  following  types  of  information
28        regarding those served by the Program:
29                  (A)  the number;
30                  (B)  the ethnic, geographic, and age breakdown;
31                  (C)  the stages of presentation; and
32                  (D)  the diagnostic and treatment status.
33             (5)  The Department or  any  entity  funded  by  the
34        Program  shall  collect  personal and medical information

 1        necessary to administer the Program from  any  individual
 2        applying   for   services   under   the  Program.     The
 3        information  shall  be  confidential  and  shall  not  be
 4        disclosed other than for purposes directly connected with
 5        the administration of the Program or except as  otherwise
 6        provided  by  law or pursuant to prior written consent of
 7        the subject of the information.
 8             (6)  The Department or  any  entity  funded  by  the
 9        program  may  disclose  the  confidential  information to
10        medical personnel and fiscal intermediaries of the  State
11        to the extent necessary to administer the Program, and to
12        other State public health agencies or medical researchers
13        if the confidential information is necessary to carry out
14        the  duties  of  those  agencies  or  researchers  in the
15        investigation,  control,  or  surveillance  of   prostate
16        cancer.
17        (c)  The  Department  shall  adopt rules to implement the
18    Prostate Cancer Screening  Program  in  accordance  with  the
19    Illinois Administrative Procedure Act.
