 1                    AMENDMENT TO SENATE BILL 652

 2        AMENDMENT NO.     .  Amend Senate Bill 652,  AS  AMENDED,
 3    with  reference  to  page and line numbers of House Amendment
 4    No. 1, as follows:
 5    on page 8, line 15, after "name", by  inserting  ",  date  of
 6    birth, social security number, if available,"; and

 7    on  page  9,  by  replacing  lines  5  through  20  with  the
 8    following:
 9        "(f-5)  Notwithstanding disclosure, a person who has been
10    convicted  of any of the following offenses at any time shall
11    be ineligible for election or appointment to a  local  school
12    council  and  ineligible  for  appointment  to a local school
13    council pursuant to subsections (l) and (m) of this  Section:
14    (i)  those  defined  in Section 11-6, 11-9.1, 11-16, 11-17.1,
15    11-19, 11-19.1,  11-19.2,  11-20.1,  12-13,  12-14,  12-14.1,
16    12-15,  or  12-16  of  the  Criminal Code of 1961 or (ii) any
17    offense committed or attempted in any other state or  against
18    the  laws  of  the  United  States,  which,  if  committed or
19    attempted in this State, would have been punishable as one or
20    more of the foregoing offenses.  Notwithstanding  disclosure,
21    a  person  who  has  been  convicted  of any of the following
22    offenses  within  the  10  years  previous  to  the  date  of
23    nomination or appointment shall be ineligible for appointment

 1    to a local school council pursuant to subsections (l) and (m)
 2    of this Section: (i) those defined in Section  401.1,  405.1,
 3    or  405.2  of  the Illinois Controlled Substances Act or (ii)
 4    any offense committed or attempted  in  any  other  state  or
 5    against the laws of the United States, which, if committed or
 6    attempted in this State, would have been punishable as one or
 7    more of the foregoing offenses.
 8        Immediately  upon election or appointment, incoming local
 9    school  council  members  shall  be  required  to  undergo  a
10    criminal background investigation, to be completed  prior  to
11    the  member  taking  office, using the member's name, date of
12    birth, and social security number, if available, in order  to
13    identify   any   criminal   convictions  under  the  offenses
14    enumerated in Section 34-18.5. In instances in which  one  or
15    more  individuals  have  the  same  name,  date of birth, and
16    social security  number  as  the  member,  the  member  shall
17    undergo  a  fingerprint background check. If it is determined
18    at  any  time  that  a  local  school   council   member   or
19    member-elect  has  been  convicted  of  any  of  the offenses
20    enumerated in this Section or failed to disclose a conviction
21    of any of the offenses enumerated  in  Section  34-18.5,  the
22    general  superintendent shall notify the local school council
23    member or member-elect of such determination  and  the  local
24    school  council  member or member-elect shall be removed from
25    the local school council by the Board, subject to a  hearing,
26    convened pursuant to Board rule, prior to removal."; and

27    on  page  18,  line  3, after "name", by inserting ", date of
28    birth, social security number, if available,"; and

29    on page 18,  by  replacing  lines  27  through  34  with  the
30    following:
31        "(f-5)  Notwithstanding disclosure, a person who has been
32    convicted  of any of the following offenses at any time shall
33    be ineligible for election or appointment to a  local  school

 1    council  and  ineligible  for  appointment  to a local school
 2    council pursuant to subsections (l) and (m) of this  Section:
 3    (i)  those  defined  in Section 11-6, 11-9.1, 11-16, 11-17.1,
 4    11-19, 11-19.1,  11-19.2,  11-20.1,  12-13,  12-14,  12-14.1,
 5    12-15,  or  12-16  of  the  Criminal Code of 1961 or (ii) any
 6    offense committed or attempted in any other state or  against
 7    the  laws  of  the  United  States,  which,  if  committed or
 8    attempted in this State, would have been punishable as one or
 9    more of the foregoing offenses.  Notwithstanding  disclosure,
10    a  person  who  has  been  convicted  of any of the following
11    offenses  within  the  10  years  previous  to  the  date  of
12    nomination or appointment shall be ineligible for appointment
13    to a local school council pursuant to subsections (l) and (m)
