1 AN ACT to amend the Illinois Marriage and Dissolution of
2 Marriage Act by adding Section 609.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Marriage and Dissolution of
6 Marriage Act is amended by adding 609.5 as follows:
7 (750 ILCS 5/609.5 new)
8 Sec. 609.5. Leave to remove children beyond 150 miles.
9 Notwithstanding any provision of Section 609 to the contrary,
10 if the court finds, after a hearing, that it is in the best
11 interest of a minor child, the court may include in the
12 initial custody judgment a provision that the custodial
13 parent may not remove a minor child to a new residence which
14 would increase the distance between the residence of the
15 child at the time of the initial custody judgment and the
16 residence of the non-custodial parent at the time of the
17 initial custody judgment by more than 150 miles without the
18 written consent of the non-custodial parent or order of the
19 court.
