 1                    AMENDMENT TO SENATE BILL 529

 2        AMENDMENT NO.     .  Amend Senate Bill  529  on  page  1,
 3    line  2,  by replacing "Section 3.26" with "Sections 3.26 and
 4    10.3"; and

 5    on page 1, line 6, by replacing "Section 3.26" with "Sections
 6    3.26 and 10.3"; and

 7    on page 3, by inserting the following immediately after  line
 8    14:

 9        "(225 ILCS 235/10.3 new)
10        Sec.  10.3.  Notification and posting for applications of
11    pesticides to school structures.
12        (a)  Notification  requirements.    It   shall   be   the
13    responsibility of the administrator of the school to post the
14    school   structure  when  pesticides  are  being  applied  in
15    accordance with the following notification procedures:
16             (1)  Signs shall be posted at least 2 business  days
17        before application of a pesticide and shall remain posted
18        at  least  2  business  days  after  application  of  the
19        pesticide.   Signs  shall  be  posted  (i) at every entry
20        point to the school structure and  (ii)  at  every  entry
21        point to the designated areas within the structure if the
22        pesticide  application  was made only to designated areas

 1        within the structure.  Signs shall be at least 6"  x  6",
 2        headed  "Notice  of  Pesticide  Application",  and bright
 3        yellow in color with black writing at least 1" in height.
 4        Signs shall identify the date of  application,  the  date
 5        and  time  for  re-entry  to  the  area  treated  if such
 6        information is specified on the pesticide label, and  the
 7        name   and   telephone  contact  number  for  the  school
 8        personnel  responsible  for  the  pesticide   application
 9        program.
10             (2)  Each   school  shall  maintain  a  registry  of
11        parents and guardians of students and of school employees
12        who have registered to receive written notification prior
13        to applications of pesticides.  Parents and guardians and
14        school employees shall be notified in writing  within  30
15        days  of  the first full day of the school year that they
16        may register for notification of pesticide  applications.
17        A   registry  notice  form  shall  be  developed  by  the
18        Department.
19             (3)  Written notification must be  provided  to  all
20        registered   parents   and   guardians  of  students  and
21        employees who attend or work at the  school  at  least  2
22        business  days before application of any pesticide to the
23        school structure.  Written  notices  shall  identify  the
24        name   and   active   ingredient   of  the  pesticide  or
25        pesticides, the intended date of the application  of  the
26        pesticide  or  pesticides, the date and time for re-entry
27        to the area treated if such information is  specified  on
28        the  pesticide  label, and the name and telephone contact
29        number for the school administrator  who  is  responsible
30        for the pesticide application program.
31             (4)  Written  notice and posting must be provided at
32        least 2 business days in advance if a school is scheduled
33        to have an application of a pesticide or pesticides on  a
34        weekend or other day when school is not is session.

 1             (5)  Prior  written  notice shall not be required if
 2        there is an imminent threat to health  or  property.   If
 3        such a situation arises, the appropriate school personnel
 4        must  sign  a statement describing the circumstances that
 5        gave rise to the health threat, ensure that posting takes
 6        place, and ensure that written notice is provided as soon
 7        as practicable.
 8        (b)  Qualifications  and  responsibilities   of   persons
 9    making the pesticide applications to the school structure.
10             (1)  Employees  of  the  school who make any general
11        use or restricted  use  pesticide  application  shall  be
12        certified in accordance with provisions of this Act.
13             (2)  Employees  of the school who make any pesticide
14        application shall comply with  the  appropriate  storage,
15        handling,  preparation  for  use, transport, and clean up
16        requirements as set forth in this Act.
17             (3)  If  the  school  contracts  with  a  commercial
18        structural  pest   control   applicator   for   pesticide
19        application, the applicator shall provide the information
20        necessary so the school administrator can comply with the
21        notice and posting requirements of this Section.

22        Section  99.  Effective date.  This Act takes effect upon
23    becoming law.".
