 1        AN ACT to amend the  Criminal  Code  of  1961  by  adding
 2    Section 17-23.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The Criminal  Code  of  1961  is  amended  by
 6    adding Section 17-23 as follows:

 7        (720 ILCS 5/17-23 new)
 8        Sec. 17-23.  Counterfeit Universal Price Code Label.
 9        (a)  A  person  who,  with  intent to defraud a merchant,
10    possesses,  uses,  transfers,   makes,   sells,   reproduces,
11    tenders,  or  delivers  a  false,  counterfeit,  altered,  or
12    simulated  Universal  Price Code Label is guilty of a Class 4
13    felony.
14        (b)  A  person  who  possesses  more  than   one   false,
15    counterfeit, altered, or simulated Universal Price Code Label
16    or  who  possesses  a  device  the  purpose  of  which  is to
17    manufacture  false,  counterfeit,   altered,   or   simulated
18    Universal Price Code Labels is guilty of a Class 3 felony.
19        (d)  Definitions.  In this Section:
20        "Universal  Price  Code Label" means a unique symbol that
21    consists of  a  machine  readable  code  and  human  readable
22    numbers.
23        "Merchant"  has  the  meaning  ascribed  to it in Section
24    16A-2.4 of this Code.
25        "Intent to defraud" has the meaning  ascribed  to  it  in
26    paragraph  (iii)  of  subsection  (A) of Section 17-1 of this
27    Code.
