 1        AN ACT concerning cancer research.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The Civil Administrative Code of Illinois is
 5    amended by adding Section 55.91 as follows:

 6        (20 ILCS 2310/55.91 new)
 7        Sec. 55.91.  Cancer Research Fund;  grants.   From  funds
 8    appropriated  from  the  Cancer Research Fund, a special fund
 9    created in  the  State  treasury,  the  Department  of  Human
10    Services  shall  make grants to public or private entities in
11    Illinois for the purpose of funding the  research  of  cancer
12    remedies.

13        Section  10.   The State Finance Act is amended by adding
14    Section 5.490 as follows:

15        (30 ILCS 105/5.490 new)
16        Sec. 5.490.  The Cancer Research Fund.

17        Section 15.  The Illinois Income Tax Act  is  amended  by
18    adding  Section  507U and changing Sections 507, 509, and 510
19    as follows:

20        (35 ILCS 5/507) (from Ch. 120, par. 5-507)
21        Sec. 507.  Child  Abuse  Prevention  Fund  Checkoff.  The
22    Department  shall print on its standard individual income tax
23    form a provision indicating that if the  taxpayer  wishes  to
24    contribute  to  the  Child  Abuse  Prevention Fund created by
25    Section 4a of the Children and Family Services  Act  "An  Act
26    creating  the  Department  of  Children  and Family Services,
27    codifying its powers and duties, and repealing  certain  Acts

 1    and Sections herein named", approved June 4, 1963, as amended
 2    ,  he  or  she  may  do  so  by  stating  the  amount of such
 3    contribution (not less than $1) on such return and that  such
 4    contributions  will  reduce the taxpayer's refund or increase
 5    the amount of payment to accompany the  return.   Failure  to
 6    remit  any  amount  of  increased  payment  shall  reduce the
 7    contribution accordingly.  This Section shall not apply to an
 8    amended return.
 9        If, on October 1 of any  year,  the  total  contributions
10    made  pursuant to this Section do not equal $100,000 or more,
11    the explanations and  spaces  for  designating  contributions
12    shall  be removed from the individual income tax return forms
13    for the following and all subsequent years and all subsequent
14    contributions to such fund shall be refunded to the taxpayer.

17        (35 ILCS 5/507U new)
18        Sec. 507U. Cancer Research Fund checkoff. The  Department
19    shall  print  on  its  standard  individual income tax form a
20    provision  indicating  that  if  the   taxpayer   wishes   to
21    contribute to the Cancer Research Fund, as authorized by this
22    amendatory Act of the 91st General Assembly, he or she may do
23    so  by  stating the amount of the contribution (not less than
24    $1) on the return and that the contribution will  reduce  the
25    taxpayer's  refund  or  increase  the  amount  of  payment to
26    accompany  the  return.  Failure  to  remit  any  amount   of
27    increased  payment shall reduce the contribution accordingly.
28    This Section shall not apply to any amended return.

30        Sec. 509.  Tax  checkoff  explanations.   All  individual
31    income   tax   return   forms   shall   contain   appropriate
32    explanations  and spaces to enable the taxpayers to designate

 1    contributions to the Child  Abuse  Prevention  Fund,  to  the
 2    Community  Health  Center Care Fund, to the Illinois Wildlife
 3    Preservation  Fund  as  required  by  the  Illinois  Non-Game
 4    Wildlife Protection Act, to the Alzheimer's Disease  Research
 5    Fund  as required by the Alzheimer's Disease Research Act, to
 6    the Assistance to the Homeless Fund as required by this  Act,
 7    to the Heritage Preservation Fund as required by the Heritage
 8    Preservation Act, to the Child Care Expansion Program Fund as
 9    required by the Child Care Expansion Program Act, to the Ryan
10    White   AIDS   Victims  Assistance  Fund,  to  the  Assistive
11    Technology  for  Persons  with  Disabilities  Fund,  to   the
12    Domestic  Violence  Shelter  and  Service Fund, to the United
13    States Olympians Assistance Fund, to  the  Youth  Drug  Abuse
14    Prevention  Fund, to the Persian Gulf Conflict Veterans Fund,
15    to the Literacy Advancement Fund, to the Ryan White Pediatric
16    and  Adult  AIDS  Fund,  to  the  Illinois  Special  Olympics
17    Checkoff Fund, to the Breast  and  Cervical  Cancer  Research
18    Fund,  to  the Korean War Memorial Fund, to the Heart Disease
19    Treatment and Prevention Fund, to  the  Hemophilia  Treatment
20    Fund,  to  the Mental Health Research Fund, to the Children's
21    Cancer Fund, to the American Diabetes  Association  Fund,  to
22    the  Women  in  Military Service Memorial Fund, to the Cancer
23    Research Fund, and to the Meals on  Wheels  Fund.  Each  form
24    shall  contain a statement that the contributions will reduce
25    the taxpayer's refund or increase the amount  of  payment  to
26    accompany  the  return.   Failure  to  remit  any  amount  of
27    increased payment shall reduce the contribution accordingly.
28        If,  on October 1 of any year, the total contributions to
29    any one of the funds made under this  Section  do  not  equal
30    $100,000 or more, the explanations and spaces for designating
31    contributions   to   the  fund  shall  be  removed  from  the
32    individual income tax return forms for the following and  all
33    subsequent   years,   unless   reinstated  by  law,  and  all
34    subsequent contributions to the fund while removed  from  the

 1    form shall be refunded to the taxpayer.

 4        (35 ILCS 5/510) (from Ch. 120, par. 5-510)
 5        Sec. 510.  Determination  of  amounts  contributed.   The
 6    Department  shall  determine  the total amount contributed to
 7    each of the following: the Child Abuse Prevention  Fund,  the
 8    Illinois  Wildlife  Preservation  Fund,  the Community Health
 9    Center Care Fund, the Assistance to the  Homeless  Fund,  the
10    Alzheimer's  Disease Research Fund, the Heritage Preservation
11    Fund, the Child Care Expansion Program Fund, the  Ryan  White
12    AIDS  Victims  Assistance  Fund, the Assistive Technology for
13    Persons with Disabilities Fund, the Domestic Violence Shelter
14    and Service Fund,  the  United  States  Olympians  Assistance
15    Fund,  the Youth Drug Abuse Prevention Fund, the Persian Gulf
16    Conflict Veterans Fund, the Literacy  Advancement  Fund,  the
17    Ryan  White  Pediatric  and  Adult  AIDS  Fund,  the Illinois
18    Special Olympics  Checkoff  Fund,  the  Breast  and  Cervical
19    Cancer Research Fund, the Korean War Memorial Fund, the Heart
20    Disease   Treatment   and  Prevention  Fund,  the  Hemophilia
21    Treatment  Fund,  the  Mental  Health  Research   Fund,   the
22    Children's  Cancer  Fund,  the American  Diabetes Association
23    Fund, the Women in Military Service Memorial Fund, the Cancer
24    Research Fund, and the Meals on Wheels Fund; and shall notify
25    the State Comptroller and the State Treasurer of the  amounts
26    to be transferred from the General Revenue Fund to each fund,
27    and upon receipt of such notification the State Treasurer and
28    Comptroller shall transfer the amounts.

31        Section 99.  Effective date.  This Act takes effect  upon
32    becoming law.
