1 HOUSE RESOLUTION
2 WHEREAS, On July 20, 1999, the Governor signed into law
3 Senate Bill 1063 (P.A. 91-212) in order to bring Illinois
4 into compliance with the Personal Responsibility and Work
5 Opportunity Reconciliation Act of 1996 which mandated that
6 the State of Illinois establish a State Disbursement Unit by
7 October 1, 1999; and
8 WHEREAS, Senate Bill 1063 created the Child Support State
9 Distribution Unit centralizing the collection of child
10 support payments through one agency rather than through 102
11 separate Circuit Clerk offices throughout the State; and
12 WHEREAS, The model was determined through extensive
13 negotiations with the Circuit Clerks of Illinois; the DuPage
14 County Circuit Clerk was selected as the entity to operate
15 the Illinois unit; and
16 WHEREAS, The Illinois Department of Public Aid is
17 required to inform those affected by the changes in child
18 support payments caused by Senate Bill 1063; and
19 WHEREAS, Thousands of Illinois children have not received
20 the support to which they are legally entitled in a timely
21 and professional manner as a result of collection and
22 distribution errors that have occurred during the initial
23 implementation of Senate Bill 1063; therefore, be it
24 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
25 NINETY-FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
26 the Auditor General be directed to conduct a management audit
27 of the Illinois Department of Public Aid's Child Support
28 State Distribution Unit; and be it further
29 RESOLVED, That this audit shall include, but not be
30 limited to, the following determinations:

1 Whether the information-gathering and technological
2 problems that now exist in the implementation of Senate
3 Bill 1063 could have been anticipated by the Illinois
4 Department of Public Aid or those charged with the
5 implementation of Senate Bill 1063; and
6 Whether the efforts of the Illinois Department of Public
7 Aid were sufficient to ensure that employers would supply
8 necessary information to the State Distribution Unit to
9 permit proper implementation of Senate Bill 1063; and
10 Whether performance incentives or penalties should be
11 required for implementation of Senate Bill 1063; and
12 Whether other changes in the implementation of Senate
13 Bill 1063 and the Child Support State Distribution Unit
14 are warranted to address any deficiencies noted in the
15 preceding determinations; and be it further
16 RESOLVED, That all State agencies, including the
17 Department of Public Aid and all other entities which may
18 have information relevant to this audit shall cooperate fully
19 and promptly with the Office of the Auditor General in the
20 conduct of this audit; and be it further
21 RESOLVED, That the Auditor General commence this audit as
22 soon as possible and report his findings and recommendations
23 upon completion to the Legislative Audit Commission, the
24 Governor, and the members of the General Assembly in
25 accordance with the provisions of the Illinois State Auditing
26 Act.
