 1                       HOUSE JOINT RESOLUTION
 2                      CONSTITUTIONAL AMENDMENT

 3        RESOLVED,   BY   THE  HOUSE  OF  REPRESENTATIVES  OF  THE
 4    NINETY-FIRST GENERAL ASSEMBLY OF THE STATE OF  ILLINOIS,  THE
 5    SENATE  CONCURRING  HEREIN,  that there shall be submitted to
 6    the electors of the State for adoption or  rejection  at  the
 7    general  election  next occurring at least 6 months after the
 8    adoption of this resolution a proposition to amend Article  V
 9    of  the  Illinois Constitution by changing Sections 1, 3, and
10    7, by adding Section 16.5, and by repealing Sections  17  and
11    18 as follows:

12                              ARTICLE V
13                            THE EXECUTIVE

14        (ILCON Art. V, Sec. 1)
15    SECTION 1. OFFICERS
16        The Executive Branch shall include a Governor, Lieutenant
17    Governor,  Attorney  General,  Secretary  of State, and State
18    Financial Officer Comptroller and Treasurer  elected  by  the
19    electors  of  the  State.  They shall keep the public records
20    and maintain a residence at the  seat  of  government  during
21    their terms of office.

24    SECTION 3. ELIGIBILITY
25        To be eligible to hold the office of Governor, Lieutenant
26    Governor,  Attorney  General,  Secretary  of  State, or State
27    Financial Officer Comptroller or Treasurer, a person must  be
28    a  United  States  citizen,  at  least  25  years  old, and a
29    resident of this State for the three years preceding  his  or
30    her election.

 1        (ILCON Art. V, Sec. 7)
 2    SECTION 7. VACANCIES IN OTHER ELECTIVE OFFICES
 3        If  the  Attorney  General,  Secretary of State, or State
 4    Financial Officer Comptroller or Treasurer fails  to  qualify
 5    or  if the his office becomes vacant, the Governor shall fill
 6    the office by appointment.  The appointee shall  hold  office
 7    until  the  elected officer qualifies or until a successor is
 8    elected and qualified as may be provided by law and shall not
 9    be subject to removal by the  Governor.   If  the  Lieutenant
10    Governor  fails  to  qualify  or  if  the  his office becomes
11    vacant, it shall remain vacant until the end of the term.

13        (ILCON Art. V, Sec. 16.5 new)
14    SECTION 16.5.  STATE FINANCIAL OFFICER - DUTIES
15        The State Financial  Officer,  in  accordance  with  law,
16    shall  (i)  maintain the State's central fiscal accounts, and
17    order payments into and out of the funds held by him  or  her
18    and  (ii)  shall  be  responsible  for  the  safekeeping  and
19    investment  of  moneys  and  securities deposited with him or
20    her, and for their disbursement upon his or her order.

21        (ILCON Art. V, Sec. 17)
22    SECTION 17. COMPTROLLER - DUTIES (REPEALED)
23        The Comptroller, in accordance with law,  shall  maintain
24    the  State's central fiscal accounts, and order payments into
25    and out of the funds held by the Treasurer.

27        (ILCON Art. V, Sec. 18)
28    SECTION 18. TREASURER - DUTIES (REPEALED)
29        The  Treasurer,  in  accordance  with   law,   shall   be
30    responsible  for the safekeeping and investment of monies and
31    securities deposited with him,  and  for  their  disbursement

 1    upon order of the Comptroller.

 3                              SCHEDULE
 4        This Constitutional Amendment takes effect as follows:
 5        (1)  those portions providing for the election of a State
 6    Financial  Officer take effect beginning with the election in
 7    2002; and
 8        (2)  those  portions  creating  the   office   of   State
 9    Financial  Officer  and  eliminating the offices of Treasurer
10    and Comptroller take effect upon the conclusion of the  terms
11    of the Treasurer and Comptroller elected in 1998.
