 1        AN  ACT  to  amend  the  School  Code by changing Section
 2    18-17.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The  School  Code  is  amended  by changing
 6    Section 18-17 as follows:

 7        (105 ILCS 5/18-17) (from Ch. 122, par. 18-17)
 8        Sec. 18-17.  The State Board of Education  shall  provide
 9    the  loan  of  secular  textbooks listed for use by the State
10    Board of Education free of charge  to  any  student  in  this
11    State  who is enrolled in grades prekindergarten kindergarten
12    through 12 at a public school or at a  school  other  than  a
13    public  school  which  is  in  compliance with the compulsory
14    attendance laws of this State  and  Title  VI  of  the  Civil
15    Rights  Act of 1964.  The foregoing service shall be provided
16    directly to the students at their request or at  the  request
17    of  their parents or guardians.  The State Board of Education
18    shall  adopt  appropriate  regulations  to  administer   this
19    Section  and to facilitate the equitable participation of all
20    students   eligible   for   benefits   hereunder,   including
21    provisions authorizing the exchange,  trade  or  transfer  of
22    loaned  secular textbooks between schools or school districts
23    for students enrolled in such schools  or  districts.   After
24    secular  textbooks have been on loan under this Section for a
25    period of 5 years or more, such textbooks may be disposed  of
26    by school districts in such manner as their respective school
27    boards  shall determine following written notification to the
28    State Board of  Education  and  expiration  of  a  reasonable
29    waiting  period  not to exceed 30 days.  Loaned textbooks may
30    not be disposed of out-of-State or  sold  without  the  prior
31    approval of the State Board of Education.

 1        As  used  in  this  Section, "textbook" means any book or
 2    book substitute  which  a  pupil  uses  as  a  text  or  text
 3    substitute  in  a  particular  class  or  program.   It shall
 4    include books, reusable workbooks, manuals, whether bound  or
 5    in  loose  leaf  form,  and  instructional computer software,
 6    intended as a principal source of study material for a  given
 7    class or group of students.

 9        Section  99.  Effective date.  This Act takes effect upon
10    becoming law.
