1 AN ACT to amend the Hospital Licensing Act.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Hospital Licensing Act is amended by
5 adding Section 12.1 as follows:
6 (210 ILCS 85/12.1 new)
7 Sec. 12.1. Report of adverse events.
8 (a) In addition to any other requirements of law, the
9 Hospital Licensing Board shall adopt rules by July 1, 2000
10 that develop standardized criteria, standards, procedures,
11 and forms by which a hospital must report an adverse event.
12 (b) Reports must be submitted in a timely manner as
13 determined by the Department.
14 (c) The Department must review the reports and may
15 conduct on-site visits for the purpose of verification and
16 classification.
17 (d) The Department may develop and maintain a central
18 information system of adverse events to support its
19 regulatory and public health functions and for research
20 purposes.
21 (e) The Department may consider other reports required
22 by law to be satisfactory for compliance with this Section.
23 (f) Information contained in a report under this Section
24 may be disclosed only if the information is included in
25 reports or information subject to disclosure under Sections
26 6.14a, 6.14b, 6.14c, 6.14d, and 9 of this Act.
27 (g) The Department must submit a report to the Governor
28 and General Assembly that contains a statistical summary of
29 the data on the adverse events by April 1 of each calendar
30 year.
31 (h) For the purposes of this Section, "adverse event"

1 means an event that seriously compromises quality assurance
2 or patient safety. "Adverse event" includes an injury to a
3 patient, an employee, or a visitor that is life-threatening,
4 results in death, or requires the person to undergo
5 significant additional diagnostic or treatment measures;
6 medication errors; major biomedical device or other equipment
7 failure resulting in serious injury or having potential for
8 serious injury; surgical errors involving the wrong patient,
9 the wrong side of the body, the wrong organ, or the retention
10 of a foreign object; blood transfusion errors; a maternal
11 death within 90 days of delivery or termination of pregnancy;
12 death of a person by suicide; infant abduction or discharge
13 to the wrong family; unlicensed practice of a regulated
14 profession; occurrences such as epidemic outbreaks,
15 poisonings, fires, major accidents, death from unnatural
16 causes, or other catastrophes and unusual occurrences that
17 threaten the welfare, safety, or health of patients,
18 personnel, or visitors. "Adverse event" also includes
19 interruptions of service at the hospital; prevalence of
20 commmunicable disease; infestation by parasites or vectors;
21 disappearance or loss of a patient; rape or other sexual acts
22 involving patients who are minors, nonconsenting adults, or
23 persons incapable of consent; physical assaults on patients,
24 employees, or visitors; and all suspected criminal activity
25 involving patients, employees, or visitors.
26 Section 99. Effective date. This Act takes effect upon
27 becoming law.
