 1        AN  ACT  to amend the Illinois Procurement Code by adding
 2    Section 30-50.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The Illinois Procurement Code is amended by
 6    adding Section 30-50 as follows:

 7        (30 ILCS 500/30-50 new)
 8        Sec. 30-50.  Illinois FIRST Job Opportunities Initiative.
 9        (a)  For any construction  contract  with  the  value  of
10    $1,000,000  or more funded in whole or part by Illinois FIRST
11    funds,  the  State  of  Illinois  shall  post  the  following
12    information  pursuant  to  the  procedures   set   forth   in
13    subsection (c):
14             (1)  the  approximate  number  of apprenticeship and
15        journeyman hours that will be required for  each  skilled
16        and unskilled trade to be utilized within any contract or
17        subcontract  to be awarded for that project, or any other
18        employment opportunity to be made available  pursuant  to
19        such contract or subcontract;
20             (2)  the  approximate  period  of  time during which
21        work  on  any  contract  or  subcontract  will  continue,
22        including  the  approximate  beginning  date   that   any
23        employment   opportunity   will  arise  pursuant  to  the
24        contract;
25             (3)  the   description   and   location    of    the
26        construction project; and
27             (4)  the  specific  procedures that must be followed
28        to apply for any employment  opportunities  arising  from
29        the contract or subcontract, including location and hours
30        of any union or other offices.
31        (b)  Any  prime  contractor  receiving  any  construction

 1    contract with the value of $1,000,000 or more funded in whole
 2    or  part by Illinois FIRST funds shall, within 30 days of the
 3    date that the prime contract is awarded by the State,  supply
 4    the  Department  of  Employment  Security with the employment
 5    information specified in subsection (a);  provided  that  for
 6    any  subcontract awarded during the duration of the contract,
 7    the information specified in subsection (a) shall be provided
 8    by the prime contractor within 30 days after  the  date  that
 9    the  subcontract  is awarded. Any such contract shall include
10    the requirement  for  the  prime  contractor  to  supply  the
11    information   within   the   timeframes  set  forth  in  this
12    subsection.
13        (c)  All employment opportunities required to  be  posted
14    under  this  Section shall be submitted by a prime contractor
15    to the Department of Employment Security, utilizing forms and
16    procedures developed and made available  by  the  Department.
17    The  Department of Employment Security shall, upon receipt of
18    such  information  from  any  prime  contractor,   post   the
19    information  on  a State of Illinois Internet site maintained
20    for that purpose, with the Job Service program maintained  by
21    the  State,  and  with  all  Illinois Employment and Training
22    Centers throughout the State. In  addition,  the  information
23    provided  to  the  Department of Employment Security shall be
24    provided by the prime contractor or his or her representative
25    to any person who seeks application for  employment  directly
26    at the job site.
27        (d)  Any prime contractor awarded a construction contract
28    with the value of $1,000,000 or more, funded in whole or part
29    by  Illinois  FIRST funds, shall submit a quarterly report to
30    the State of Illinois that shall include  information  as  to
31    the  number  of  apprenticeship  and journeyman hours in each
32    skilled and unskilled trade in  which  women  and  minorities
33    were  employed  during  the  preceding  quarter. The Governor
34    shall designate an office within a State agency that shall be

 1    responsible for the development and dissemination of a simple
 2    reporting form, both in paper and electronic  format,  to  be
 3    utilized  by prime contractors covered under this Section and
 4    shall be further responsible for monitoring  compliance  with
 5    the  reporting requirements specified in this subsection. Any
 6    report submitted pursuant to this subsection  shall  be  made
 7    available,  at  a nominal charge, to any member of the public
 8    who requests a copy.

 9        Section 99.  Effective date.  This Act takes effect  upon
10    becoming law.
