1 AN ACT to amend the Illinois Pension Code and the State
2 Mandates Act.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Pension Code is amended by
6 adding Section 6-141.2 as follows:
7 (40 ILCS 5/6-141.2 new)
8 Sec. 6-141.2. Minimum annuity for certain widows.
9 Notwithstanding the other provisions of this Article, the
10 widow's annuity payable to the widow of a fireman who dies on
11 or after July 1, 1997 while an active fireman with at least
12 10 years of creditable service shall be no less than 50% of
13 the retirement annuity that the deceased fireman would have
14 been eligible to receive if he had attained age 50 and 20
15 years of service on the day before his death and retired on
16 that day.
17 Section 90. The State Mandates Act is amended by adding
18 Section 8.24 as follows:
19 (30 ILCS 805/8.24 new)
20 Sec. 8.24. Exempt mandate. Notwithstanding Sections 6
21 and 8 of this Act, no reimbursement by the State is required
22 for the implementation of any mandate created by this
23 amendatory Act of the 91st General Assembly.
24 Section 99. Effective date. This Act takes effect upon
25 becoming law.
