1 AN ACT to amend the Public Utilities Act by adding
2 Section 8-600.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Public Utilities Act is amended by adding
6 Section 8-600 as follows:
7 (220 ILCS 5/8-600 new)
8 Sec. 8-600. Reliability of facilities; enforcement. The
9 Commission, after notice and hearing held on complaint or on
10 the Commission's motion, has authority to:
11 (1) order a public utility to correct any
12 inadequacy in service reliability in violation of or
13 non-conformance with the provisions of this Act or
14 Commission rules, including orders to perform specific
15 remedial actions by specified dates;
16 (2) impose financial penalties for violations of or
17 non-conformances with the provisions of this Act or
18 Commission rules respecting reliability, not to exceed
19 (i) $10,000 per occurrence or (ii) $30,000 per day for
20 those violations or non-conformances that continue after
21 the deadline for correction established in a Commission
22 order to correct a reliability deficiency; and
23 (3) alter, modify, revoke, or suspend the
24 certificate of service authority of a public utility for
25 substantial or repeated violations of or non-conformances
26 with the provisions of this Act or Commission rules
27 respecting reliability.
28 Section 99. Effective date. This Act takes effect upon
29 becoming law.
