 1                    AMENDMENT TO HOUSE BILL 2605

 2        AMENDMENT NO.     .  Amend House Bill 2605 as follows:

 3    on page  1,  by  replacing  lines  22  through  28  with  the
 4    following:

 5        "(1)  Soil  loss on cropland is at or below the tolerable
 6    soil loss level as  certified  by  a  local  Soil  and  Water
 7    Conservation District.
 8        (2)  An approved farm conservation plan is on file at the
 9    local Soil and Water Conservation District office.
10        (3)  If  the farm is required to have a vegetative filter
11    strip, adjacent to a body of water, the strip was constructed
12    in accordance with the USDA  Natural  Resources  Conservation
13    Service Technical Guide.
14        (4)  Evidence  of  participation  in programs such as the
15    USDA's Conservation  Reserve  Program,  Conservation  Reserve
16    Enhancement  Program,  and  Environmental  Quality Incentives
17    Program, or the Department's Conservation  2000  Conservation
18    Practices  Program, and Agricultural Areas in accordance with
19    Illinois' Agricultural Areas Conservation and Protection Act,
20    can be considered but is not required to be designated  as  a
21    "Rivers-Friendly Farmer"."; and

22    on page 2, by deleting lines 1 through 22; and

 1    on page 2, below line 24, by inserting the following:

 2        "Section  30.  Processing  Fee.  Any local Soil and Water
 3    Conservation  District  that  chooses  to  review  a  written
 4    application for the "Rivers-Friendly Farmer" designation  may
 5    collect a reasonable fee for services rendered.
 6        The    Department   of   Agriculture   may   collect   an
 7    administrative filing fee of $15 for each application  for  a
 8    "Rivers-Friendly   Farmer"  designation.   In  addition,  the
 9    Department shall collect an  amount  equal  to  the  cost  of
10    providing   a   sign   that   designates   a   farmer   as  a
11    "Rivers-Friendly Farmer".
12        All moneys collected by the Department shall be deposited
13    into a promotional trust account as provided in Section  40.7
14    of  the  Civil  Administrative  Code  of  Illinois.     Funds
15    collected  shall  be  used  for  the  purposes of the program
16    authorized by this Act.".
