 1        AN ACT in relation to local government.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Governmental Account Audit Act is amended
 5    by changing Section 2 as follows:

 6        (50 ILCS 310/2) (from Ch. 85, par. 702)
 7        Sec. 2.  Audit and report.   Except as otherwise provided
 8    in  Section  3,  the governing body of each governmental unit
 9    shall cause an audit of the accounts of the unit to  be  made
10    by  a  licensed  public  accountant. Such audit shall be made
11    annually and shall cover  the  immediately  preceding  fiscal
12    year  of  the  governmental unit. The audit shall include all
13    the accounts and funds of the  governmental  unit,  including
14    the  accounts  of  any  officer  of the governmental unit who
15    receives fees or handles funds of  the  unit  or  who  spends
16    money  of the unit. The audit shall begin as soon as possible
17    after the close of the last fiscal year to which it pertains,
18    and shall be completed and the audit report  filed  with  the
19    Comptroller  within  6  months after the close of such fiscal
20    year  unless  an  extension  of  time  is  granted   by   the
21    Comptroller  in writing.  An audit report which fails to meet
22    the requirements  of  this  Act  shall  be  rejected  by  the
23    Comptroller  and  returned  to  the  governing  body  of  the
24    governmental  unit for corrective action. The licensed public
25    accountant making the audit shall  submit  not  less  than  3
26    copies  of  the  audit  report  to  the governing body of the
27    governmental unit being audited.

29        Section 10.  The Counties Code  is  amended  by  changing
30    Section 5-1004 as follows:

 2        Sec.  5-1004. Exercise of corporate powers. The powers of
 3    the county as a body corporate or politic, shall be exercised
 4    by a county board as  follows,  to  wit:  In  counties  under
 5    township  organization  (except  the  County of Cook), by the
 6    county board members  elected  under  Division  2-3;  in  the
 7    County  of Cook, by a board of county commissioners, pursuant
 8    to Section 3 of Article VII of the Illinois Constitution;  in
 9    counties  not  under  township  organization, by the board of
10    county commissioners.

12        Section 15.  The Illinois Municipal Code  is  amended  by
13    changing Section 2-2-12 as follows:

15        Sec.  2-2-12.  Corporate  powers.     Cities incorporated
16    under this Code shall be bodies politic and  corporate  under
17    the name of "City of (name)," and under that name may sue and
18    be  sued,  contract  and be contracted with, acquire and hold
19    real and personal property for  corporate  purposes,  have  a
20    corporate  seal, changeable at pleasure, and exercise all the
21    powers hereinafter conferred.

23        Section 20.  The Fire Protection District Act is  amended
24    by changing Section 1.04 as follows:

25        (70 ILCS 705/1.04) (from Ch. 127 1/2, par. 21d)
26        Sec. 1.04.  Notice of election.   Whenever a county clerk
27    or other election authority places upon a ballot the question
28    of  creating  or  altering  a  fire protection district, such
29    clerk or other election authority shall notify the Office  of
30    the  State  Fire Marshal that such a proposition is to be put

 1    before the electorate.  Such notice  shall  be  sent  to  the
 2    Office of the State Fire Marshal within 10 working days after
 3    the  question  is  certified  to  the clerk or other election
 4    authority.
