 1        AN ACT to amend the Northeastern Illinois University  Law
 2    by changing Sections 25-15 and 25-25.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The Northeastern Illinois University  Law  is
 6    amended by changing Sections 25-15 and 25-25 as follows:

 7        (110 ILCS 680/25-15)
 8        Sec.  25-15.  Membership;  terms;  vacancies.   The Board
 9    shall consist of 9 7 voting members who are residents of this
10    State and are appointed by  the  Governor  by  and  with  the
11    advice  and  consent  of the Senate, and, until July 1, 2001,
12    one voting member who is a student at  Northeastern  Illinois
13    University.   The  student member serving on the Board on the
14    effective date of this amendatory Act  of  1997  shall  be  a
15    voting student member for the remainder of his or her term on
16    the  Board.   Beginning  on July 1, 2001, and thereafter, the
17    student member of the Board  shall  be  a  nonvoting  member.
18    Beginning  with  the  1999-2000  academic  year,  the student
19    member shall be elected by a campus-wide  referendum  of  all
20    students  of  the  University.    The method of selecting the
21    student  member  shall  continue  to  be  determined   by   a
22    campus-wide  student  referendum.    The student member shall
23    serve a term of one year beginning on July 1  of  each  year,
24    except  that the student member initially selected under this
25    amendatory Act of the 91st General  Assembly  shall  serve  a
26    term  beginning  on  the  date  of  his  or her selection and
27    expiring on the next succeeding June 30.  To be  eligible  to
28    remain  as  a student member of the Board, the student member
29    must be a resident of this State, must have  and  maintain  a
30    grade  point  average that is equivalent to at least 2.5 on a
31    4.0 scale, and must be  a  full  time  undergraduate  student

 1    enrolled at all times during his or her term of office except
 2    for that part of the term which follows the completion of the
 3    last  full  regular semester of an academic year and precedes
 4    the first full regular semester of  the  succeeding  academic
 5    year at the university (sometimes commonly referred to as the
 6    summer  session  or  summer  school).   If  a  student member
 7    serving on the Board fails to continue to  meet  or  maintain
 8    the  residency,  minimum  grade  point average, or enrollment
 9    requirement  established  by  this  Section,   his   or   her
10    membership on the Board shall be deemed to have terminated by
11    operation of law. If any member of the Board appointed by the
12    Governor  fails to continue to meet or maintain the residency
13    requirement established by this  Section,  he  or  she  shall
14    resign membership on the Board within 30 days thereafter and,
15    failing submission of this resignation, his or her membership
16    on  the Board shall be deemed to have terminated by operation
17    of law. Of the members first appointed  by  the  Governor,  4
18    shall be appointed for terms to expire on the third Monday in
19    January,  1999  and  until their successors are appointed and
20    qualified, and 3 shall be appointed for terms  to  expire  on
21    the  third Monday in January, 2001 and until their successors
22    are  appointed  and  qualified.  The  2  additional   members
23    appointed by the Governor, by and with the advice and consent
24    of  the Senate, under this amendatory Act of the 91st General
25    Assembly, shall not be from  the  same  political  party  and
26    shall be appointed for terms to expire on the third Monday in
27    January,  2003  and  until their successors are appointed and
28    qualified.  Any vacancy in membership existing on January  1,
29    1999 shall be filled by appointment by the Governor, with the
30    advice and consent of the Senate, for a term to expire on the
31    third  Monday  in  January,  2003.    If the Senate is not in
32    session on the effective  date  of  this  Article,  or  if  a
33    vacancy in an appointive membership occurs at a time when the
34    Senate  is  not in session, the Governor shall make temporary

 1    appointments  to  fill  the  vacancy.   Members  with   these
 2    temporary  appointments  shall  be  deemed qualified to serve
 3    upon appointment and shall continue to serve until  the  next
 4    meeting  of  the  Senate  when  the Governor he shall appoint
 5    nominate persons to fill such memberships, by  and  with  the
 6    advice  and consent of the Senate, for the remainder of their
 7    respective terms. No more than 5 4 of the  members  appointed
 8    by  the  Governor shall be affiliated with the same political
 9    party. Upon the expiration of the terms of members  appointed
10    by  the Governor for other than temporary appointments, their
11    respective successors shall be appointed,  by  and  with  the
12    advice  and  consent of the Senate, for terms of 6 years from
13    the third Monday in January of each  odd-numbered  year.  Any
14    members  appointed  to  the  Board shall continue to serve in
15    such  capacity  until  their  successors  are  appointed  and
16    qualified.

20        Sec. 25-25.  Officers; meetings.  Members  of  the  Board
21    appointed  by  the  Governor  shall  elect annually by secret
22    ballot from their own number a chairperson, who  shall  serve
23    for a period of 2 years from his or her election and chairman
24      who  shall  preside  over  meetings  of  the  Board,  and a
25    secretary, and other officers that the Board deems necessary.
26    The secretary and other  officers  shall  also  serve  for  a
27    period of 2 years from their election.
28        Meetings  of  the  Board shall be held at least once each
29    quarter on the campus of Northeastern Illinois University  at
30    Chicago,  Illinois.  At  all regular meetings of the Board, a
31    majority of  its  members  shall  constitute  a  quorum.  The
32    student   member   shall   have  all  of  the  privileges  of
33    membership, including the right to make and  second  motions,

 1    to  attend executive sessions, and until July 1, 2001 to vote
 2    on all Board matters except those involving  faculty  tenure,
 3    faculty  promotion  or  any issue on which the student member
 4    has a direct conflict of interest.  Unless the student member
 5    is entitled to vote on a measure at a meeting of the Board or
 6    any of its committees, he or she shall not  be  considered  a
 7    member  for  the  purpose  of determining whether a quorum is
 8    present at the time that measure is voted  upon.   No  action
 9    of  the Board shall be invalidated by reason of any vacancies
10    on the Board or by reason of any failure to select a  student
11    member.
12        Special  meetings  of  the  Board  may  be  called by the
13    chairperson chairman of the Board or by any 4  3  members  of
14    the Board.

16        Section  99.  Effective date.  This Act takes effect upon
17    becoming law.
