 1        AN  ACT concerning the distribution of tobacco litigation
 2    settlement proceeds.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The  State Finance Act is amended by adding
 6    Sections 5.490 and 6z-43 as follows:

 7        (30 ILCS 105/5.490 new)
 8        Sec. 5.490.  Tobacco Settlement Recovery Fund.

10        Sec. 6z-43.  Tobacco Settlement Recovery Fund.  There  is
11    created  in  the  State Treasury a special fund to  be  known
12    as  the  Tobacco Settlement Recovery Fund  into  which  shall
13    be  deposited  all  monies  paid  to  the  State pursuant  to
14    (1)  the  Master  Settlement Agreement entered in the case of
15    People of the State of Illinois  v.  Philip  Morris,  et  al.
16    (Circuit  Court  of  Cook County, No. 96-L13146) and  (2) any
17    settlement with  or  judgment  against  any  tobacco  product
18    manufacturer  other   than  one participating in  the  Master
19    Settlement Agreement in satisfaction of any released claim as
20    defined  in the  Master Settlement Agreement, as well as  any
21    other  monies  as   provided  by law. All  earnings  on  Fund
22    investments shall be deposited into the Fund.  The moneys  in
23    the  Fund  shall be used as provided in Section 5-5.22 of the
24    Illinois Public Aid Code and as otherwise provided by law.

25        Section 10.  The Illinois Public Aid Code is  amended  by
26    adding Section 5-5.22 as follows:

28        Sec.  5-5.22.   Replacement  of nursing home licensed bed

 1    fee with tobacco settlement proceeds.  Beginning  on  January
 2    1,  2000  and  on the first day of each month thereafter, the
 3    State Comptroller  shall  order  transferred  and  the  State
 4    Treasurer shall transfer from the Tobacco Settlement Recovery
 5    Fund  to  the  Long-Term  Care  Provider  Fund,  the existing
 6    balance in the Tobacco  Settlement  Recovery  Fund  until  at
 7    least  $55,000,000 has been transferred to the Long-Term Care
 8    Provider Fund during that fiscal year.  The transferred money
 9    shall replace the nursing home licensed day bed  fee  imposed
10    by Article 5E which is repealed by this amendatory Act of the
11    91st General Assembly.

13        Section  15.   The Illinois Public Aid Code is amended by
14    repealing Article V-E.
