 1        AN  ACT  to  amend  the  Sale of Tobacco to Minors Act by
 2    changing Section 1.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.  The Sale of Tobacco to Minors Act is amended
 6    by changing Section 1 as follows:

 7        (720 ILCS 675/1) (from Ch. 23, par. 2357)
 8        Sec. 1.  No minor under 18 years of  age  shall  buy  any
 9    cigar,  cigarette, smokeless tobacco or tobacco in any of its
10    forms. No person shall sell, buy for, distribute  samples  of
11    or furnish any cigar, cigarette, smokeless tobacco or tobacco
12    in any of its forms, to any minor under 18 years of age.
13        No  person  may  sell, buy for, distribute samples of, or
14    furnish any cigar, cigarette, smokeless tobacco,  or  tobacco
15    in any of its forms, to any person 27 years of age or younger
16    without  first demanding adequate written evidence of age and
17    identity of the person by  the  presentation  of  a  document
18    issued  by a federal, State, county, or municipal government,
19    or  subdivision  or  agency  of  any  of  these   governments
20    containing  positive  proof of the person's age and identity,
21    including,  but  not  limited  to,  a  drivers   license,   a
22    registration  certificate  issued under the Federal Selective
23    Service Act, or an identification card issued to a member  of
24    the Armed Forces.
25        For  the  purpose  of  this  Section, "smokeless tobacco"
26    means any tobacco products that are suitable for  dipping  or
27    chewing.
28        Tobacco  products  listed  above  may  be  sold through a
29    vending machine only in the following locations:
30             (1)  Factories, businesses, offices, private  clubs,
31        and other places not open to the general public.

 1             (2)  Places  to  which  minors under 18 years of age
 2        are not permitted access.
 3             (3)  Places where alcoholic beverages are  sold  and
 4        consumed on the premises.
 5             (4)  Places  where  the vending machine is under the
 6        direct supervision of the owner of the  establishment  or
 7        an  employee  over  18 years of age.  The sale of tobacco
 8        products from a vending machine under direct  supervision
 9        of  the  owner  or  an  employee  of the establishment is
10        considered a sale of tobacco products by that person.  As
11        used in this subdivision, "direct supervision" means that
12        the owner or employee has an unimpeded line of  sight  to
13        the vending machine.
14             (5)  Places  where  the  vending machine can only be
15        operated by the owner or an employee over age  18  either
16        directly or through a remote control device if the device
17        is inaccessible to all customers.

19        Section  99.  Effective date.  This Act takes effect upon
20    becoming law.
