1 AN ACT to amend the Local Governmental and Governmental
2 Employees Tort Immunity Act by adding 2-110.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Local Governmental and Governmental
6 Employees Tort Immunity Act is amended by adding Section
7 2-110.5 as follows:
8 (745 ILCS 10/2-110.5 new)
9 Sec. 2-110.5. Year 2000 date change. A local public
10 entity is not liable for failing to provide any public
11 service on account of any disruptions caused by the year 2000
12 date change.
13 No cause of action, including, without limitation, any
14 civil action or any action for declaratory or injunctive
15 relief, may be brought against a local public entity or any
16 of its agencies, officers, or employees on the basis that a
17 computer or other information system that is owned or
18 operated by the local public entity or any of its agencies,
19 offices, or employees produced, calculated, or generated an
20 incorrect date, regardless of the cause of the error.
21 Any contract entered into by or on behalf of a local
22 public entity or any of its agencies, officers, or employees
23 must include a provision that provides immunity to the local
24 public entity and its agencies, officers, and employees for
25 any breach of contract that is caused by an incorrect date
26 being produced, calculated, or generated by a computer or
27 other information system that is owned or operated by the
28 local public entity or any of its agencies, officers, or
29 employees, regardless of the cause of the error. Any contract
30 subject to the provisions of this Section that is entered
31 into on or after the effective date of this amendatory Act of

1 the 9lst General Assembly has the legal effect of including
2 the immunity required by this Section and any provision of
3 the contract that is in conflict with this Section is void.
